Everyone gets a prenup — you either intentionally create one yourselves, or the laws of the state create one for you.
Marriage is emotional, spiritual, and legal. A nikah/marriage certificate is ultimately a contract recognized by the court.
Marriage is legally viewed as a partnership.
Even if one spouse is not earning income outside the home, unpaid labor still has value: pregnancy, childbirth, breastfeeding, raising children, managing the home, emotional labor, and supporting a spouse’s career.
When divorce happens, the two biggest issues usually become:
• Child custody/support
• Division of financial assets
What will custody look like when children are young?
Some couples may choose to discuss:
• Children remaining primarily with the mother during breastfeeding years ; or younger years
• Structured visitation schedules
• Decision-making responsibilities
How will children’s expenses be divided?
• Health insurance
• Childcare
• Extracurriculars
• School tuition
• Medical expenses
• College savings
FINANCIAL ASSETS
In many states, assets built during the marriage are considered joint property — even if only one person’s name is on the deed or account.
Important conversations include:
• Retirement accounts
• Health insurance coverage
• Savings contributions
• Separate personal accounts
• Emergency funds
• Expectations regarding work, childcare, and household responsibilities
Love is important.
But clarity, transparency, and intentional planning matter too.
