Pakistan Mediators Association PMA is Pakistan’s first organization representing foreign trained and accredited mediators to promote Mediation & ADR all over Pakistan

Pakistan Mediators Association is Pakistan’s first organization representing foreign trained and accredited mediators as well as other professionals who have joined the Association to further the cause of the Association. The Association was formed in 2013 and has taken over number of activities which were earlier implemented by IFC/World Bank Group’s Alternative Dispute Resolution (ADR) Pakistan

Project Phase 1&2. While Karachi Centre for Dispute Resolution (KCDR) and Lahore Chamber of Commerce and Industry’s mediation centre is functional and providing mediation services, it was deemed essential to promote development of ADR and mediation in other parts of Pakistan. In this regard, representation in Association has been provided to Pakistani professionals belonging to all provinces while it is acknowledged that it will take time to provide capacity building opportunities to professionals based in KPK and Baluchistan provinces.

Objectives of PMA:

Considering that Pakistan’s contract enforcement indicators are not encouraging and it takes number of years and cost of contract enforcement. PMA resolves to lead and support interventions which will enable litigants and disputants to resolve disputes amicably and through mediation process. PMA’s aims and objects therefore include the following:

a) Promotion of mediation process for resolution of disputes.

b) Support to government, semi-government and non-governmental organizations in law reforms pertaining to ADR and mediation.

c) Awareness raising among various groups, professionals and entities on mediation.

d) Provision of capacity building opportunities for professionals in field of mediation.

e) Network and develop and maintain linkages with likeminded local and foreign based organizations in field of mediation.

f) Hold conferences, workshops and other forums in field of mediation in Pakistan.

What is Mediation?

Mediation, as used in law, is a form of alternative dispute resolution (ADR), a way of resolving disputes between two or more parties with concrete effects. Typically, a third party, the mediator, assists the parties to negotiate a settlement. Disputants may mediate disputes in a variety of domains, such as commercial, legal, diplomatic, workplace, community and family matters.

The term 'mediation' broadly refers to any instance in which a third party helps others reach agreement. More specifically, mediation has a structure, timetable and dynamics that "ordinary" negotiation lacks. The process is private and confidential, possibly enforced by law. Participation is typically voluntary. The mediator acts as a neutral third party and facilitates rather than directs the process.

Mediators use various techniques to open, or improve, dialogue and empathy between disputants, aiming to help the parties reach an agreement. Much depends on the mediator's skill and training. As the practice gained popularity, training programs, certifications and licensing followed, producing trained, professional mediators committed to the discipline.
