What is Due Diligence?
As per teacher Wikipedia:
Due diligence is the investigation or exercise of care that a reasonable business or person is normally expected to take before entering into an agreement or contract with another party or an act with a certain standard of care.
Due diligence can be a legal obligation, but the term more commonly applies to voluntary investigations.
It may also offer a defence against legal action.
A common example of due diligence is the process through which a potential acquirer evaluates a target company or its assets in advance of a merger or acquisition.
The theory behind due diligence holds that performing this type of investigation contributes significantly to informed decision making by enhancing the amount and quality of information available to decision makers and by ensuring that this information is systematically used to deliberate on the decision at hand and all its costs, benefits, and risks.
For me,
Real Estate Due Diligence is an essential process that thoroughly investigates a property's legal, financial, and physical aspects to make risks and make informed decisions.
It is essential to understand things like land ownership laws, property valuation, and development regulations.
As a Real Estate Broker, we should help our clients in doing due diligence. I, myself personally know the land owners, the history of the property and all the facts about the property that my clients are interested in.
Ang pag aahente ng lupa at Real Estate properties ay hindi basta pag aalok lang sa buyers ng available na property. Maraming factors na kailangang isaalang- alang.
Kagaya ng :
1.) Available ba ang titulo at updated ba ang buwisan nito?
2.) Ang original bang may ari na nakapangalan sa titulo ay buhay pa?
3.) Kung patay na ang nakapangalan na may ari, bayad na ba ang Estate Tax? Kung Oo, may kopya ba ng Tax Clearance?
4.) Kung patay na ang orihinal na may ari ng property, nailipat na ba sa mga legal na tagapagmana ng property ang mga ari- a***n?
5.) Kung ang propety ba na ibinebenta ay tunay na nakapangalan sa nagbebenta o na land grab lang?
6.) Kung ang property ba ay may mga informal settlers, hindi ba magkakaproblem ang client sa pagbili nito?
7.) Kung agritultural land ba ang property, possible may farmer na tenant ito. Naibigay na ba ng may ari ang award nilang lupa?
8.) Kung ang property title ay CLOA, matured na ba ito?
9.) Nakasangla ba ang titulo? If yes, willing ba ang may ari na masettle ito bago ibenta?
10.) Feasible ba ang property sa gustong ilagay ng client na bibili? Whether ito ay residential, agricultural, industrial at commercial property, kailangan mong usisain ito.
