๐Ÿญ๐Ÿด ๐—๐—ฎ๐—ป๐˜‚๐—ฎ๐—ฟ๐˜† ๐Ÿฎ๐Ÿฌ๐Ÿฎ๐Ÿญโ€”As part of its continuing efforts to dispose overstaying shipments, the BOC Port of Cebu resolved a total 119 seizure and forfeiture proceedings in 2020โ€”the most number of seizure cases that the Port has resolved in a calendar year.

One hundred nine (109) of the 119 cases resulted to forfeiture of goods in favor of the government, while ten (10) cases were allowed for settlement after payment of fine.

โ€œWe endeavor to resolve all seizure and forfeiture proceedings within a reasonable period of time as delay spells forgone revenues for the government and stockpiling of containers in our yards,โ€ said Law Division Acting Chief Atty. Vicente Andrew M. Espina.

When a shipment is issued a Warrant of Seizure and Detention after finding probable cause for violation of the Customs Modernization and Tariff Act (CMTA), it undergoes seizure and forfeiture proceeding to determine whether the same should be forfeited in favor of the government, allowed for settlement or redemption after payment of fine, or released to the claimant.

Forfeited shipments may be disposed through donation or turn-over to other government agencies, public auction sale, or condemnation through destruction in accordance with Sections 1141 to 1150 of the CMTA.

๐Ÿฎ๐Ÿฐ ๐——๐—ฒ๐—ฐ๐—ฒ๐—บ๐—ฏ๐—ฒ๐—ฟ ๐Ÿฎ๐Ÿฌ๐Ÿฎ๐Ÿฌ - A day before Christmas, the Bureau of Customs Port of Cebu has already hit its monthly revenue collection target for December, collecting Php2.684 Billion in the first 23 days of the month. This is over the Php2.554 Billion revenue target for the month by Php130 Million or 5.08 percent.

The Port which already exceeded the Php27.539 Billion annual target for the year as early as November, increased their 2020 collection surplus to Php3.017 Billion to date. This figure is still expected to increase by yearend, as collections continue to come in for the last days of December.

Port of Cebu Acting District Collector Charlito Martin R. Mendoza attributes the good performance of the Port to the frontline officers of the Port who he described as, โ€œtirelessly putting in the extra effort this December to process and release goods without delay.โ€

There is an expected slowdown in Port transactions between Christmas and New Year as many importers and brokers have already cleared their shipments for the year. District Collector Mendoza encouraged Port personnel to make the most of the holidays to spend time with family.

โ€œThe best Christmas gift is to be able to celebrate with family and have a few days of rest to recharge and recover, knowing that you have done your best, and contributed your most, under the worst of times,โ€ District Collector Mendoza wrote in his Christmas message to the Portโ€™s personnel.

On 20 November 2020, Judge Allan B. Ariola, Branch 48, Metropolitan Trial Court of Pasay City, found guilty as charged the apprehended importer of 757 pieces of tarantulas in BOC-NAIA for violation of Section 27 of Republic Act No. 9147 otherwise known as the Wildlife Resources Conservation and Protection Act of 2001, and Section 1401 in relation to Section 117 of Republic Act No. 10863 otherwise known as the Customs Modernization and Tariff Act. He was sentenced to serve a straight penalty of six (6) months imprisonment and ordered to pay fine in the aggregate amount of One Hundred Twenty Thousand Pesos (Php120,000.00).

It can be recalled that the convicted wildlife smuggler was apprehended by BOC-NAIA frontliners, ESS-NAIA, CIIS-NAIA and XIP-NAIA operatives, in collaboration with DENR-NCR operatives last April 1, 2019 while claiming the illegally imported 757 tarantulas concealed inside boxes of cookies and oatmeal from Poland, at the Central Mail Exchange Center, without the required import permit from the Department of Environment and Natural Resources (DENR). The seized tarantulas were immediately turned over to the Wildlife Traffic Monitoring Unit of the Department of Natural Resources.

District Collector Carmelita M. Talusan commended the efforts of BOC-NAIA frontliners, ESS-NAIA, CIIS-NAIA, and full support and active collaboration of DENR-NCR and the Office of the City Prosecutor of Pasay City in the successful conviction of the wildlife smuggler. She emphasized that the said conviction clearly manifests the seriousness and commitment of the Bureau of Customs under the leadership of Commissioner Rey Leonardo B. Guerrero to penalize smugglers of illegal goods and contrabands; and serve as a deterrent and warning to others engaging in similar illegal activities that the full force of law will eventually place them behind bars.

As part of the Bureau of Customs' (BOC) efforts to protect the public from goods that are harmful and unfit for consumption, Bureau of Customs-NAIA, last December 7, 2020, condemned 4.28 tons of unregistered and hazardous goods in Trece Martires, Cavite.

The condemnation of unregistered cosmetics and food products is part of Bureau of Customs border protection initiatives to protect the public against unsafe and hazardous consumer products.

The goods were destroyed using the Thermal Decomposer (Pyrolysis) Facility of the Integrated Waste Management Inc. (IWMI) to ensure that these items will not be sold or made available in the market.

For the year 2020, Port of NAIA has already condemned a total of 371.42 tons of unregistered and hazardous goods. This is also in compliance with Commissioner Rey Leonardo B. Guerreroโ€™s directive to decongest all ports and warehouses.

As public safety is of primordial importance under the leadership of Commissioner Rey Leonardo Guerrero, amidst COVID-19 pandemic, District Collector Carmelita Talusan vowed BOC-NAIAโ€™s continued vigilance against the influx of dangerous drugs, anti-social goods and hazardous substances.

The Bureau of Customs โ€“ NAIA, in coordination with the Philippine Postal Corporation (Philpost), intercepted 38 parcels with 75 poker chip-sets and other gambling paraphernalia imported in the Central Mail Exchange Center (CMEC). The items were without the required permit from the Philippine Amusement and Gaming Corporation (PAGCOR).

Thru the vigilance of BOC-NAIA frontliners, Customs Intelligence & Investigation Service (CIIS-NAIA), Enforcement and Security Service (ESS-NAIA), X-ray Inspection Project (XIP-NAIA), shipments were apprehended in violation of Section 119 (b) of the R.A. 10863 or the Customs Modernization and Tariff Act (CMTA).

The intercepted poker sets, dealer chips, and other gambling paraphernalia shall be turned over to the Auction and Cargo Disposal Division for safe keeping pending seizure and forfeiture proceedings.

After the finality of Decision of Forfeiture, the forfeited gambling paraphernalia shall be turned over to PAGCOR pursuant to Section 1147 (b) of the CMTA (Disposition of gambling outfits, apparatus, paraphernalia).

District Collector Carmelita M. Talusan will continue to be in full support to the intensified enforcement and prosecution of smuggling drive of Commissioner Rey Leonardo B. Guerrero and will continue to remain focused in their collective efforts to protect the countryโ€™s premier airport against all fraudulent and illegal attempts to import restricted products.
