Kami sedia bekerjasama dengan pertubuhan, NGO, koperasi atau badan korporat untuk memberi kesedaran tentang hal-hal pewarisan Islam kepada orang ramai.

Lawatan kami semalam adalah ke ibu pejabat MARA.

Satu perbincangan yang sangat baik telah diadakan mengenai perlunya perancangan harta, satu perkara yang sangat penting dalam kehidupan seseorang beragama Islam.

Bagi seseorang muslim yang meninggal dunia dan tidak merancang sebaiknya harta peninggalan mereka, dia sebenarnya telah melanggar garis panduan yang telah ditetapkan sebagai seorang muslim

Prinsip utama panduan kehidupan sehingga peringkat kematian yang bersifat menyeluruh yang ditekankan oleh agama Islam, nyata gagal diterima sepenuhnya oleh umat Islam yang akhirnya menyebabkan sebahagian dari mereka tidak merancang pengagihan harta setelah kematian.

Situasi ini menyebabkan wujudnya perdebatan antara ahli keluarga atau waris yang berhak dan ini menjadi faktor kepada harta tidak dituntut setelah kematian seseorang individu.

Perkembangan semasa pengurusan harta pusaka di Malaysia masih tidak menggalakkan walaupun pelbagai usaha telah dilaksanakan oleh pihak berwajib dan pemain industri.

Inisiatif awal telah dibuat oleh pihak Kerajaan Malaysia dengan menubuhkan institusi dikenali sebagai Amanah Raya Berhad serta seterusnya kemunculan pelbagai pemain industri swasta dalam menyediakan khidmat pengurusan harta pusaka serta yang berkaitan.

Namun demikian, sehingga kini, sejumlah 700,000 individu sahaja telah melaksanakan deklarasi wasiat berbanding bilangan umat Islam di Malaysia yang mencecah 30 juta orang. Perbezaan yang amat ketara ini berhubung individu beragama Islam yang mempunyai wasiat dan yang tidak berwasiat membuka kepada persoalan apakah dilema yang dihadapi dalam pengurusan harta Islam di Malaysia.

Ground breaking islamic estate administration service that addresses the main issues that could lead to the estates being unclaimed and frozen indefinitely

The pain points in islamic estate administration are:

🔷Complicated Estate Administration Process. Upon demise of a muslim, their heirs will need to undergo both Shariah law process and Civil law process in order to claim the estates of the deceased. Shariah court’s jurisdiction include issuance of faraid certificate and determining the rights of related parties via will, hibah or claim on matrimonial assets. Civil law jurisdictions entails powers of Amanah Raya Berhad, Small Estate Distribution Office and Civil High Court. Heirs usually find the processes involved are complicated and difficult to comprehend.

🔷Lengthy procedure. In most cases, the heirs face time constraints due to career, personal life and family life. They do not have the luxury of time to take the initiative to visit all the relevant government agencies to complete the documentation’s requirement to apply for the estate administration process.

đź”·Dispute Among Heirs. Another challenge to the estate administration process is dispute among heirs that may arise due to lack of knowledge in relation to faraid law and hukum of estates in Islam. Dispute may prolong and increase the cost of the estate administration process not to mention possible friction in relationship among the heirs.

đź”·Expensive Estate Administration Fees. According to section 43 Probate and Administration Act 1959, any parties acting on behalf of the heirs to execute the estate administration process can charge up to 5 % from the gross estate value of the estates as their estate administration fee.

These issues can be addressed through an innovative ground breaking estate administration services, the first and only of its kind in Malaysia.

The normal practise in the industry, if a professional third party is appointed to execute the estate administration process, a fee up to a few percentum from the gross estate value will be charged to the estate or to the heirs.

Through this service known as Al Wasitah, a personalised service will be provided to assist the heirs to go through all estate administration process without charging any service fees to the heirs. Subscribers will be issued with a Kad Legasi.

Having been informed by the heirs, the company will send its legal officer to the heir’s home or at any agreed location, to give a personalised estate administration consultation to all heirs. The consultation includes knowledge on hukum of estates in Islam, the faraid distribution, the responsibilities of heirs and explanation on the estate administration process that the heirs will need to go through.

The heirs only need to bear the statutory costs charged by the relevant authorities.

There is only one trustee company in Malaysia that provides such a service.

Isu harta pusaka terus menjadi masalah di Malaysia apabila dianggarkan lebih RM100 bilion jumlah har­ta beku dan tidak dituntut di ne­gara ini direkodkan melibatkan 90 peratus daripadanya milik orang Melayu.

Ketidakpastian mengenai harta pusaka yang terbengkalai menjadi salah satu punca utama ketidakupayaan untuk menuntut pusaka kerana kekurangan maklumat aset yang diperlukan untuk proses pengurusan pusaka.

Punca Proses Tuntutan Harta Pusaka Tertangguh

Semalam saya telah dapat membantu seorang sahabat saya untuk menguruskan harta pusaka arwah adik dia yang telah meninggal dunia beberapa tahun yang lalu.

Atas sebab tertentu, pengurusan harta tersebut tidak dapat dilaksanakan oleh isteri dan anak-anak arwah tersebut, dan tanggungjawab ini diambil oleh sahabat saya ini setelah dia hadiri sesi zoom yang saya kendalikan mengenai proses tuntutan harta pusaka.

Secara am, seharusnya, setelah selesai semua urusan pengebumian, waris akan beralih kepada pengurusan harta pusaka arwah.

Harapan waris ialah harta yang ditinggalkan mampu diwarisi secepatnya, namun pelbagai proses dan kekangan perlu dilalui.

Tracing the Family Tree to appreciate our ancestry and heritage.

It began when my beloved youngest aunty whom I call Cik Su, Dato’ Nik Noraini Yahya came to visit her sister, who is my mother whose name is Nik Zawiah Yahya.

Many knows Dato’ Nik Noraini, especially among ladies, as a propagator of knowledge in aspects of Islam. Others, including me, know her as one of the kindest and most caring soul anyone could ever come across masyaAllah.

Together in Cik Su’s “entourage” are two of her children (my cousins), one of whom was Datuk Wira Dr Asyraf Wajdi Dusuki, presently the Chairman of Majlis Amanah Rakyat, and also Dr Farah Nini Dusuki, the children’s commissioner to the Human Rights Commission of Malaysia (Suhakam). Cik Su’s husband, Dato' Haji Dusuki Ahmad who is Chairman of Majlis Ulama UMNO also kindly came to visit as well Nini’s husband Abdul Rahman Ahmad Mahidin and her son in law, Dr Matin.

In response to my question as to what the name of my great-grandmother was, both Cik Su and my mother started to verbally trace out the Family Tree starting from my great-grandparents.

We had never done this before and it was a significant moment for me and my cousins, as this was not previously done before.

More significant was the fact that my 86-year old mother does not always remember past events but she was in her element yesterday, clearly stating names of people who were present in my childhood but now have been long gone.

The significance of a family tree lies in its ability to represent the connections and relationships among family members across generations. It helps individuals understand their ancestry, heritage, and familial relationships, fostering a sense of identity and belonging.

This reminder of our ancestry is more important now than ever as most of us have moved away from our hometown, away from our state of Kelantan and most are residing in Kuala Lumpur.

It would be a such a pity if we rub shoulders with our relatives in a busy lift of a shopping complex while not knowing that we are blood relatives.

Anyway, the conversation started because some of us will be meeting up this weekend as ancestors of a couple who had lived and married many decades ago and created the Al-Ibrahimi clan.

I’m looking forward to that event.

The role of mosques in providing knowledge to its community

I dropped by at the mosque which is to be the venue of the “Seminar on Inheritance” this coming Saturday, and I was amazed at the support that the mosque is giving in promoting this activity through buntings and banner around the mosque.

I was amazed because the seminar is not directly related to religion such as religious rituals of solat (prayers) or fasting or hajj, but to knowledge which I would categorise as “muamalat” (transactions), which is usually not emphasised enough at the mosques even though it is something we do everyday.

Historically, the mosque has been a very important institution in Islam from the very beginning of its history.

In fact the mosque was the first institution established by the Prophet, even before entering the city of Yathrib, later renamed Madinah. The original purpose of the mosque was to foster piety and unity.

In the early time, the mosque is the place of learning and teaching; people learn everything in the mosque, and this includes the study of Qur'an, writing, reading as well as the knowledge of science, arithmetic, biology, history, law and others.

However times have changed and so has the role of mosque in education. Today, people learn about islam in mosques while all other knowledge is done in formal settings like schools and universities.

What about other knowledge that is not taught formally in educational establishments like muamalat? Muamalat literally means "transactions" or "dealings" and is a part of Islamic jurisprudence, or fiqh.

Put simply, muamalat is the knowledge of Shariah rulings that relates to the practical aspects of a muslim in the area of business and financial dealings.

It is something that we do everyday, but most of us do not get a formal education on it.

We learn about it as we trudge along, and sometimes to be told to “not place your money there as it is haram (forbidden)”. Oops!

Anyway, back to the mosque in widening its activities to include seminars such as inheritance or financial planning and the like.

I welcome such move and hope that other mosques emulate their openness in this matter.

I have no doubt that other experts in various fields of knowledge would also be happy to share to masjid communities such as knowledge in health, in environment, in ethics and such like.

Besides serving as a center for religious education, mosques can provide support to improve the socio-economic condition of society. This can be achieved through interventions that strengthen the role of mosques, enabling them to fulfill educational, social, and economic functions.

It was the first day of the second half of the year.

It is a perfect time to reset our goals and a great time to reflect on our progress and plan for the second half of the year.

It wasn’t a usual venue for such a serious matter when icebreaking was done in the “freezing” river water and the whole setting is among the trees of a tropical jungle, but the event met its objectives of serious goal-setting amidst tears and with hearts bursting with energy and determination.

We are consultants of islamic inheritance at Wasiyyah Shoppe Bhd, the biggest islamic trustee company in Malaysia.

“Mum, you don’t need a course on Public Speaking. You speak all the time in public or at home for as long as I remember!”

That’s what you get for being a daughter of a former university professor! Haha.

Actually my dearest daughter, it never hurts to improve your skills when it comes to public speaking.

Whether it’s making slight improvements to give you an extra boost of confidence or you want to improve as an aspiring speaker (a future TED speaker perhaps) there’s something for everyone.

No matter how old you are, no matter what your circumstances in life are, no matter how poor or how good you think your public speaking is, it is never too late to make it better.

Public speaking is a skill that doesn’t become less important over time. Communication has, and always will be, important in your life.

Hence the reason why I signed up to become a student of a 10 weeks course on public speaking.

Public speaking isn’t just about standing on a stage.

When you’re speaking to someone outside a private setting, that’s public speaking.

When you are presenting to prospects on your products and services, that’s public speaking.

When you relate your holiday story to friends and acquaintances at a lunch event, that’s public speaking.

When you’re being interviewed for a job, that’s public speaking.

The list goes on, but you can see that public speaking happens in many situations, even if you didn’t think so before.

Good communication skills can go a long way into making sure the other party understands what you wish to convey.

Other people are afraid of public speaking because they aren’t sure that their voices and ideas aren’t worth listening to.

But actually, everyone has something worth listening to, even if they don’t know it.

Hence why I’m presently a public-speaking student for the next 10 weeks with classes, assignments and all.

Are you also doing a project that you’re most excited about these days without having to stop doing other spiritual, community or family responsibilities that you are committed to? Then you’re like me.

Islamic Trusts and Business Succession Plans as Tools in Estate Planning for the Wealthy Muslims

An increasing number of Muslim high net worth individuals are exploring options and structures that can help them achieve strategic objectives and optimal arrangements in asset management, planning and distribution, and one way to do that is to set up a trust.

A trust is a relationship whereby property is held by one party for the benefit of another. It is created by a settlor, who transfers some or all of his or her property to a trustee, who holds that property for the specified beneficiaries.

A family trust is a trust that can benefit the children, grandchildren, siblings, spouse or other family members of the person establishing the trust. Family trusts are common in estate planning to ensure certain beneficiaries receive assets when the settlor dies.

"Institutional Reforms and the Federal Constitution for a Better Malaysia"

That was the title of the forum at a book launch, in which the panel were of various backgrounds from the Deputy Chairman of the Malaysian Election Committee to a political activist cm writer to an exPTD officer cm civil activist and to a representation from the Professors Council of Malaysia, hence the kinds of reforms discussed ranged from educational reforms to reforms in the political arena.

The keynote address was excellently delivered by YAM Tunku Zain Al’Abidin ibni Tuanku Muhriz.

The book was simply titled “G25 Statements” and as indicated by the title, the publication is a compilation of public statements issued by the G25 since December 2014.

In the preface of the book, it is stated that the purpose of the compilation is to advance the cause of reforms that are fundamental to making Malaysia a progressive country with all races and communities enjoying the cultural and religious diversity as one happy, united, peaceful, prosperous and harmonious nation.

Issues personally close to my heart include “G25 Statement in Support of a New Pensioner’s Scheme”, “Debunking Vaccine Myths” and “English Language Issue in Malaysia Revisited”. There are a couple of hundreds more that I intend to delve into.

There is a wealth of information available in this book on matters which I may not previously be interested in but with the research and experience that goes into coming out with the statements, I am looking forward to sitting down quietly to gain the knowledge and opinions which I may not totally agree with but I would know what are in the minds of others and be better for it. Amiin.
