Sharing a good read on Public Liability insurance
Public Liability Insurance is a type of general insurance that protects businesses and individuals against legal liability for claims made by third parties (members of the public, customers, visitors, or other non-employees) for accidental bodily injury, illness, death, or property damage arising from the insured's business operations or activities.
It indemnifies (compensates) you for sums you become legally liable to pay, including:
- Bodily injury (including death or illness) to any third party.
- Loss or damage to third-party property.
- Legal costs and expenses (claimant’s costs and your defence costs, usually with the insurer’s prior consent).
- Coverage applies only to accidental incidents occurring during the policy period, within the specified geographical limits (typically Malaysia, and sometimes extended), and in connection with your business as described in the policy schedule.
It is particularly important for businesses that interact with the public, such as:
- Restaurants (for some reason, I think this sort of coverage is especially needed for "creative" restaurants that for example, have their customers dine in the dark).
- Retail shops.
- Clinics
- Contractors
It is not compulsory under Malaysian law for most businesses (unlike Workers’ Compensation or Motor Insurance). However, many contracts (especially government, construction, or tenancy agreements) require it as a condition.
Common Exclusions — Injury to employees (covered under separate workers’ compensation), damage to your own property, professional negligence (needs Professional Indemnity), intentional acts, pollution (often excluded or limited), asbestos, cyber risks, etc.
Example:
A customer slips and falls in your shop due to a wet floor and sues you for medical bills and lost income. Public liability insurance would cover the legal defence and any compensation you are ordered to pay (subject to policy terms and limits).
