The probate process, if required, can be time consuming and involve legal complexities that executors must navigate. The beneficiaries might become impatient due to delays in receiving their inheritances.
如果需要进行遗嘱认证，可能会耗费大量时间，并涉及执行人必须应对的法律复杂性。受益人可能因遗产分配的延迟而变得不耐烦。

2️⃣Estate Administration Fees 遗产管理费用：

Inheritance can have legal fees or tax implications, and beneficiaries might not be prepared for having enough funding to pay off the liabilities associated with their inherited assets.

2️⃣Speed Up Asset Distribution 加速资产分配:
A Will speed up asset distribution to beneficiaries, making the process faster than without one. Without a Will, it can be more time-consuming when a person passes away.

无经验的执行人，增添大家烦恼

法律上没有对执行人有特别的要求，
只要是18岁以上，都可以作为你的遗产执行人。
你可以委任朋友，亲戚，甚至一家信托公司作为你的遗嘱执行人。

以下是遗嘱执行人的一般职责👇👇
1. 找到遗嘱正本
2. 与受益人安排遗嘱阅读环节
3. 确定法定住所
4. 收集所有资料和文件，以确定死者的资产和负债
5. 要求冻结资产/银行账户/信用卡等交易
6. 准备资产及负债清单，用来提交遗嘱认证申请
7. 委任一名律师向高等法院申请授予遗嘱认证
8. 出席高等法院的聆讯
9. 当遗嘱认证被授予时，提取遗嘱认证书（Grant of Probate)
10. 收集、保护和投资资产
11. 清缴死者的个人所得税
12. 在报纸上刊登，通知债权人
13. 确定财产负债并进行清算，协商支付
14. 按照债务优先次序缴纳税款、债务和遗产负债
15. 按照遗嘱分配净资产余额
16. 管理遗嘱信托(如有)
17. 准备遗产的财务报表
18. 准备并提交每个行政年度的遗产所得税申报表，并支付遗产所得税

管理遗产期间的费用和开销，遗嘱执行人有权利在合理范围内从遗产中扣除。

所以，选择合适的执行人非常重要。不合适的执行人可能会衍生额外的麻烦，影响遗产分配的效率和结果。

遗嘱里的4个关键人物
缺了他，你的遗嘱无法执行！

很多人认为立遗嘱是自己一个人的事🙅

大马法律规定，立遗嘱之前，必须想清楚这4个人是谁：

1️⃣ 执行人
资格：年满18或以上，精神健全，非破产人士。
*执行可为受益人（最多4位执行人）
责任：偿还葬礼费用，债务和税务，分配资产给受益人

2️⃣ 监护人
资格：年满18或以上，精神健全
一般配偶会自动成为监护人
责任：能够照顾未成年子女，提供基本经济支持
孩子年满21岁时，监护人职责将终止

3️⃣受益人/ 继承人
资格：任何人（*未满18岁的需要监护人）
破产人士和遗嘱见证人不能是受益人

4️⃣ 见证人
资格：年满18或以上，精神健全，非遗产受益人
*不要找年龄相差太大担任见证人，等到遗嘱生效时，ta可能已先去世或者年纪大糊涂了，不方便处理继承手续

责任：需出席遗嘱公证流程。若遗嘱被挑战，需出庭作证
