DO NOT ADMIT LIABILITY…
All motor insurance policies have that disclaimer why is it so,
Motor claims which the above disclaimer apply are either material damage or injury claims,
let’s start with the Material damage,
Material Damage is whereby in the event of an accident only the motor vehicles are damaged and no injury to either the passengers or the driver.
The reason why you should not admit liability in such a case is because in every damage there is an element of negligence from the all parties. If you admit liability, you put your insurer in a difficult situation, its like negotiating for something then another person pays and you don’t know their budget.
Injury claims, This is whereby in the event of an accident one of the occupants of the motor vehicles/vehicle involved has been injured.
This is one of the most complex one because you cannot quantify the life of a person in monetary terms and most of these cases have to be determined by the courts the reason they take long to be paid. Save for the small claims which can be referred to the small claims court. (a court which settles for claims which are less than 1 million)
In the above two the material damage is the easiest to settle and in most cases the police will tell the parties involved…
