The Kenya Bankers Association (KBA) appeared before the Departmental Committee on Finance and National Planning on Thursday, May 21, 2026, opposing Finance Bill 2026 provisions that would introduce Withholding Tax on card transaction fees and a 16% VAT on digital payment processing and money transfers.

KBA warned the combined tax burden would raise total digital transaction costs from 15% to 58.4%, risking financial exclusion and reversing a December 2025 Supreme Court ruling that classified interchange and merchant fees as operational service fees rather than royalties.

The lobby also challenged a clause empowering the KRA Commissioner to deem 60% of undistributed business income as dividends subject to immediate taxation, arguing the threshold threatens bank stability and credit expansion.

KBA noted the sector contributed KSh 1.1 trillion in taxes between 2018 and 2024.

Kenya's Finance Bill 2026 proposes broadening the excise duty base for betting by replacing the current deposit-based trigger with a wider definition covering any funds made available for gambling, including tokens, credits and chips.

The 5% rate remains unchanged but the expanded definition increases the volume of taxable transactions. The Bill also removes the horse racing exemption and clarifies that the 10% excise duty on virtual assets applies to fees charged by licensed virtual asset service providers on digital asset transactions.
