RCM ka matlab sirf “badi companies ka jhanjhat” nahi hai 🚨

Agar aap ek chhote GST taxpayer ho aur sochte ho RCM sirf large corporates ka problem hai — ye video aapke liye hai.

5 common business expenses jinme aap khud GST pay karne ke liable ho sakte ho, supplier nahi:
🚛 Transport (GTA) — freight bills
🛡️ Security services
🏠 Rent — residential aur commercial dono
⚖️ Legal/Advocate fees
👔 Director’s services

Lekin yahan sabse bada trap hai: RCM automatic nahi lagta. Har transaction ke apne conditions hain — supplier registered hai ya nahi, body corporate hai ya proprietorship, recipient kis category mein aata hai, aur service business use mein hai ya personal.

Especially Transaction 3 (Rent) pe dhyan dena — agar residential property lekar business expense mein claim kar rahe ho, RCM applicable ho sakta hai, chahe wo purely “personal” jaisa lage. Ye distinction bahut log miss karte hain.

Aur yaad rakhna — RCM sirf liability nahi hai, agar conditions match karte hain toh ITC bhi claim kar sakte ho, subject to eligibility. Sirf “GST bharna hai” mat sochiye — “sahi tareeke se compliance karna hai” sochiye.

🏠 **Can Section 54F exemption be denied just because the new house was purchased from your husband?**

**ITAT Mumbai says — Not merely for that reason.**

In *Neha Karan Motwani v. ITO*, the assessee claimed **₹6.91 crore exemption u/s 54F** on purchase of a residential property for **₹7.50 crore from her husband’s proprietorship concern**.

The AO treated it as a colourable device for tax avoidance. However, ITAT Mumbai noted that the transaction was genuine, consideration was actually paid and documented, and the husband’s business losses arose only later.

⚖️ **Held:** A genuine transaction between spouses cannot be treated as a colourable device merely because it is between family members.

📌 **Key takeaway:**
**Transaction with spouse ≠ automatically colourable device.**
What matters is genuineness, documentation, consideration and compliance with the statutory conditions.

GST include karo toh turnover ₹11.59 Cr. Exclude karo toh ₹9.82 Cr. 🤔 Ek number pe penalty, doosre pe nahi — par ITAT ne yeh sawaal answer hi nahi kiya

GSTR-1 mein invoice value ₹11.59 Cr (GST included) — ₹10 Cr audit limit cross. AO ne ₹1.5 lakh penalty laga diya Section 271B ke under.

Assessee ka case: actual sales ₹9.82 Cr, GST toh sirf liability hai P&L mein income nahi. ICAI Guidance Note ka reference bhi diya. CIT(A) ne phir bhi penalty confirm kar diya.

ITAT ne turnover ka sawaal decide nahi kiya — sirf yeh dekha ki belief bona fide tha ya nahi. Jab do views possible hon aur mala fide intent na ho, penalty automatic nahi hota — “may,” “shall” nahi. Penalty delete.

Turnover ₹1.5 Cr, cash sirf 8%... aur genuinely confuse ho gaya main bhi. 🤔

Reality check: 44AD ka 5% test sirf limit ko 2Cr→3Cr badhata hai. 44AB ka 5% test audit threshold decide karta hai. Dono ALAG sections hain, alag purpose ke liye — par log inko mix kar dete hain.

🚨 44AD & 44ADA — You DON’T have to stop at 6%, 8% or 50%!

One of the biggest misconceptions about Presumptive Taxation is that the prescribed percentage is the maximum income you can declare.

❌ WRONG!
Under Section 44AD / 44ADA, the prescribed percentage is the basis for computing presumptive income. But if your actual business or professional income is HIGHER, you can and should offer the higher income to tax.

📌 Example:
Turnover = ₹50 lakh
44AD presumptive income @ 8% = ₹4 lakh

But if your actual income is ₹7 lakh, you can offer ₹7 lakh.

The law does NOT say that you must restrict your taxable income to the presumptive percentage.

💡 Presumptive taxation simplifies computation — it does not give you a licence to suppress higher actual income.
