Finance Bill 2017 has been passed by both the house of parliament and after receiving the accent from President on 31st March 2017 has become Finance Act 2017. We have listed down important changes under Income Tax Act which shall be applicable from 1st April 2017 i.e. Assessment Year 2018-2019.

Relating to Cash Payments/ receipts

The limit for payment of expenses by Cash Under Section 40A(3) (for both Capital and Revenue expenditure) has been reduced from 20,000 to Rs.10,000 per day in aggregate per person. Expenditure in excess of given limit would be disallowed. Even the capital expenditure incurred would not be treated as cost incurred for depreciation purposes.The limit for receipt of amount in Cash has been prescribed as 2,00,000.No person shall accept amount of Rs.2,00,000 or more by Cash either in one transaction or from one person in aggregate in a day or in relation to one event or occasion from a person. In case of default equivalent penalty shall be leviable U/s 271DA of Income Tax Act.Cash donations exceeding Rs.2,000 will not be eligible for deduction under Section 80G.Existing TCS provisions requiring collection of tax @ 1% on cash sales exceeding Rs.5 Lacs in case of bullion/ jewellery and Rs.2 Lacs in case of other goods/ services has been withdrawn since cash receipts exceeding Rs.2 Lacs have been made liable for equivalent penalty.

Relating to Capital Gains

The holding period of immovable property for being considered long term has been reduced to 2 years from earlier 3 years. Hence, Immovable property held for two years or more would attract a tax rate of 20% being long term capital gains.Base year for adjusting prices for inflation, has now been changed to April 1st 2001 from 1st April 1981.

Relating to Tax Rates

The tax rate on income between Rs.2.5 lakh to Rs.5 lakh has been reduced to 5% from earlier 10%. It will reduce the tax by 50% for people having income ranging 2,50,000-5,00,000 and other taxpayers with higher income shall get benefit of Rs.12,500.The Tax Rebate u/s 87A is reduced to 2,500 from Rs.5,000per year for taxpayers with Income up to Rs.3.5 Lakh (Earlier Rs.5 Lakh). The taxpayers whose annual taxable income is Rs.3.5 Lakh, shall be required to pay Income tax of Rs.2,575 instead of Rs.5,150.Surcharge at 10% of tax is levied on persons with income ranging between Rs.50 lakh to Rs.1 crore. The rate of surcharge for the super-rich, with income above Rs.1 crore, will remain 15%.The Rate, in case of presumptive Income, for assesses having turnover less than Rs.2 Crore under section 44AD has been revised as follows:For Non Cash Sales : Net Profit will be taken at 6% of Turnover.For Cash Sales : It will remain same at 8%The Individual and HUF (not subject to Tax Audit Requirement) shall be required to deduct TDS @5%on rental payments above Rs.50,000 per month. (to be effective from 1st June 2017)

Filing of Income Tax Returns

Tax Filing will be simplified and converted to a one-page document for people with a taxable income of up to Rs. 50 Lakhs (Excluding Business Income)Delay in filing of Income tax return for 2017-18 will attract penalty of Rs.5,000/-if filed by December 31st 2018 and Rs.10,000 if filed later.

Others

Income tax officials will be able to reopen the cases as old as 10 years, if search operations reveal undisclosed income and assets of over Rs.50 Lakhs.From July 1st2017, quoting Aadhaar Number will be mandatory while applying for a PAN Card as well as for filing Income Tax Returns.⁠⁠⁠⁠

To enrol with the GST Common Portal, you need to perform the following steps.

1. Get the Provisional ID and Password of existing dealer from the State VAT authority. 2. Access the www.gst.gov.in. 3. Click the New user login. (Note-In case you have not received or lost your Provisional ID and Password, contact your state VAT department) × 4. For Provisional ID and Password verification, In the E-mail address field, enter your E-mail address and in the mobile number field, enter your mobile number. 5. Two OTPs will be sent on your e-mail address and mobile number you just mentioned. Both OTPs are required for the verification (e-mail address and mobile number cannot be changed till 01/04/2017). 6. After verifying the Provisional ID, the new credentials page is displayed. In the new user field, enter a Username for yourself and in the new password field, enter a new Password for yourself. 7. Now you can login to the GST Common Portal using the username and password you just created. 8. After login to the GST Common Portal, provide all the required details in relation to - Business details Promoters/ Partners Authorized Signatory Principal place of business Additional place of business Good & services Bank Account Verification 9. Under Business details, following details are required - Legal Name of Business (as per PAN). Legal name of business (as per current a/c) PAN of the business State Ward/circle/sector Registration no., registration type and date of registration. Scenarios where you cannot Avail Input Tax Credit Scenarios where input tax is not allowed

In our previous blog we learned about the conditions for availing GST input tax credit and the scenarios in which input tax credit (ITC) can be availed. In this blog, we will discuss the scenarios where you cannot avail Input Tax Credit.

Registration not applied for within 30 days from the date on which you become liable to register
If you have not applied for registration within 30 days from the date on which you become liable to register, you will lose the eligible ITC on inputs and inputs contained in semi-finished or finished goods in stock, on the day before the date on which you become liable to pay tax.

After the time limit for availing Input Tax Credit is crossed
ITC must be availed within the earliest of the following dates-
• 1 year of date of the invoice
OR
• The date of filing of the return for September of the next financial year
OR
• The date of filing of the annual return (due date is 31st December of the next financial year)

Let us understand this with an illustration.

Example: Rajesh Apparel Pvt Ltd is a dealer in men’s apparel. It purchases apparel for Rs.1,00,000 from the manufacturer on 15th July, 2017. GST paid on the purchase is Rs.18,000 (18%). They have filed their annual return for the year ‘17-’18 on 31st July 2018, and the return for September 2018 is filed on 20th October 2018.

Here, the three dates to be checked are-

1 year from date of invoice 14th July 2018
Date of filing of return for September of the next financial year 20th October 2018
Date of filing of annual return 31st July 2018
As 1 year from the date of invoice, i.e. 14th July 2018 is the earliest among the three dates above, ITC on the invoice must be availed before 14th July 2018.

On goods and/or services used as inputs by a composition tax payer
A composition tax payer cannot avail ITC on goods and/or services used as inputs.

Example: Laxmi Kirana Stores is registered as a composition tax payer under GST. It purchases grocery items from the manufacturer for Rs.20,000 and GST is charged @ 12% amounting to Rs.2,400. As Laxmi Kirana Stores is registered as a composition tax payer, it cannot avail ITC of Rs.2,400 on the purchase. This GST paid will become part of their material cost.

On goods and/or services used for personal consumption
Example: Rajesh Apparel Pvt Ltd purchased apparel for Rs.50,000 from the manufacturer. GST paid on the purchase is Rs.9,000. Out of the apparel purchased, apparel worth Rs.2,000 is taken by the owner for his personal use. The remaining apparel are sold to customers. Here, the ITC to be availed on the purchase is Rs.8,640 (48,000 *18%).

On goods and/or services used for making exempt supplies
ITC cannot be availed on goods and/or services used for making exempt supplies and supplies where the receiver pays tax on reverse charge basis.

Example: You manufacture an exempt good. You purchase the following inputs (used to manufacture the exempt good) on 4th September 2017-

Inward supplies- 4.9.2017
Inputs Value (Rs.) GST paid on inputs @ 18% (Rs.)
Raw material A 3,00,000 54,000
Raw material B 30,000 5,400
Total 3,30,000 59,400
Here, you cannot avail the ITC of Rs.59,400 as these inputs have been used for manufacturing an exempt good.

On services received for which payment has not been made within 3 months from the date of invoice
If the recipient of a service has not made payment for the receipt of the service along with the tax payable within 3 months from the date of invoice, the ITC availed will be added to the recipient’s liability, along with interest due.

Example: You have taken auditing and consultancy services from a Chartered Accountant. The value of the service is Rs.50,000 and the GST charged is Rs.9,000 (@18%). If you do not make the payment of Rs.59,000 within 3 months of the invoice date, the ITC of Rs.9,000 availed by you will be added to your liability, along with the interest due.

On goods lost, stolen, destroyed, written off or disposed as gift or free samples
Example: You are an electronic goods dealer. On 1st Nov, 2017, you purchase 20 computers @ Rs. 25,000 each from the manufacturer. GST charged is Rs.90,000 (@18%). On 2nd Nov, 2017, 1 of the computers gets destroyed completely and cannot be used any more. You cannot avail the ITC on that computer, i.e., Rs. 4,500.

On motor vehicles and other conveyance
ITC is not allowed on motor vehicles and other conveyance unless they are:

• Further supplied OR
• Used for transporting passengers or goods OR
• Used for imparting training on driving, flying, or navigating such vehicles or conveyances

Example: Super Cars Pvt Ltd, a car manufacturer, purchased a Tempo Traveler for the transport of employees within the factory premises. Super Cars Pvt Ltd cannot avail ITC on the Tempo Traveler as it has not been used for the above activities.

Let us look at another scenario. Mukesh Travels, a tour operator, purchased a Tempo Traveler for the purpose of transporting tourists during their package tours. Here, Mukesh Travels can avail ITC on the Tempo Traveler, as it is used for transporting passengers – a business activity for Mukesh Travels.

On food and beverages, outdoor catering, beauty treatment, health services, cosmetic and plastic surgery
ITC cannot be availed on food and beverages, outdoor catering, beauty treatment, health services and cosmetic and plastic surgery, except where they have been used for making outward supply of the same category of goods or services.
Example 1: Super Cars Pvt Ltd take the services of a caterer, Rakesh Caterers, for Diwali Celebration event for its employees. Super Cars Pvt Ltd cannot avail ITC on the catering service, as their business activity is not catering service.

Example 2: Rakesh Caterers take the services of a Shamiana provider while providing the catering service to Super Cars Pvt Ltd. Here, Rakesh Caterers can avail ITC on the Shamiana services, as they have been used for making outward supplies of the same category of services.

On membership of clubs and health & fitness centres, rent-a-cab services and life & health insurance taken for employees, except notified services which are obligatory to be provided to employees
Example: Mukesh Travels, a tour operator, takes an annual membership of a fitness centre, Pratham Fitness Centre, for the use of its employees. Here, Mukesh Travels cannot avail ITC on the GST paid on membership charges.

On travel benefits to employees on vacation, such as leave or home travel concession
Example: Super Cars Pvt Ltd reimburses its senior employees on travel expenses as part of LTA (Leave Travel Allowance). Super Cars Pvt Ltd cannot avail ITC on the GST component of the travel fare reimbursed.

On tax component of cost of capital goods, if depreciation has been claimed on the tax component
ITC cannot be availed on the tax component of cost of capital goods, if depreciation has been claimed on the tax component in Income Tax return.

Example: Super Cars Pvt Ltd purchases machinery for Rs.50,00,000 to be used for the manufacture of cars. The GST paid on the machinery is Rs.9,00,000. Super Cars Pvt Ltd claims depreciation of Rs.59,00,000 on the machinery under Income Tax, which is including the GST component. In this case, Super Cars Pvt Ltd cannot avail the ITC of Rs.9,00,000 on the machinery.
Treatment of Input Tax Credit already availed in exceptional scenarios

When a regular dealer who has availed ITC switches to the composition scheme
When a regular dealer who has availed ITC switches to the composition scheme, the person must pay back the ITC availed on inputs in stock, inputs in semi-finished state, finished goods in stock and capital goods (reduced by the prescribed percentage points) on the day before the date of switching to the composition scheme.

Example: You are registered as a regular dealer. You switch to the composition scheme on 1st September 2017 as your turnover does not exceed Rs.50 Lakhs. On 31st August 2017, you have the following inputs in stock on which ITC has already been availed-

Closing stock- 31.8.2017
Inputs Value (Rs.) GST paid on inputs @ 18% (Rs.)
Raw material A 1,50,000 27,000
Raw material B 20,000 3,600
Total 1,70,000 30,600
On switching to the composition scheme, you have to pay back the ITC of Rs.30,600 availed on the inputs in stock.

When taxable goods and/or services become exempt
When taxable goods and/or services supplied by a person are notified as exempt, the person must pay back the ITC availed on inputs in stock, inputs in semi-finished or finished goods in stock and capital goods (reduced by the prescribed percentage points) on the day before the date of exemption.
Example: You manufacture a taxable good, which is notified to be exempt from GST with effect from 15th September 2017. On 14th September 2017, you have the following inputs in stock on which GST has already been availed-

Closing stock- 14.9.2017
Inputs Value (Rs.) GST paid on inputs @ 18% (Rs.)
Raw materials 1,00,000 18,000
Inputs in semi-finished goods 50,000 9,000
Total 1,50,000 27,000
The ITC availed on the inputs in stock, ie. Rs.27,000 will have to be paid back.

Note: GST rates are not finalised yet and the rates mentioned in the examples are for illustration purpose only.

Is GST on Track? What we can Infer from the Budget Speech Budget 2017 and GST

Our Finance Minister, Mr. Arun Jaitley, in his Budget Speech, did not elaborately discuss the road map of GST. However, he did indicate that the passage of the Constitutional amendment bill for GST and progress of its implementation is a “Tectonic Policy Initiative”.

While briefing the house on the benefits of GST, he said, “the advantages of GST for our economy in terms of spurring growth, competitiveness, indirect tax simplification and greater transparency have already been extensively discussed in both houses of Parliament. I thank all members of both the Houses for having passed the Constitution Amendment unanimously”. He also thanked the State Governments for resolving all relevant issues in the GST Council. This is a clear indication from the Finance Minister that major hurdles to GST implantation are cleared from the GST Council.

The FM said that the GST Council held 9 meetings to discuss various issues relating to GST, including broad contours of the GST rate structure, threshold exemption and parameters for composition scheme, details for compensation to States due to implementation of GST, examination of draft model GST law, draft IGST law and the Compensation Law and administrative mechanism for GST. Further he said that the GST Council has finalised its recommendations on almost all the issues based on consensus.

Regarding readiness of the new law, our FM said that several teams of officers both from the States and Central Board of Excise and Customs have been working tirelessly to give finishing touches to the model GST law and rules and other details. He Indicated that extensive reach-out efforts to trade and industry for GST will start from 1st April, 2017 to make them aware of the new taxation system. He also confirmed that GSTN’s (IT arm of GST) preparation of IT systems for GST is also on schedule.

Regarding the date of implementation, the Minister said, the Centre, through the Central Board of Excise & Customs, shall continue to strive to achieve the goal of implementation of GST as per schedule. Even though the Honourable minister did not spell out the date of implementation, the Revenue Secretary to the Ministry of Finance, Government India, Mr.Hasmukh Adhia did confirm to a private news channel that GST will be implemented on July 1st 2017. He also informed that the Govt. has pegged indirect tax growth of 8.8% while calculating the revenue for the fiscal year 2017-18.

The highlight of the Finance Minister’s speech is that he has pegged the fiscal deficit for 2017-18 at 3.2% of GDP and remains committed to achieve 3% in the following year. With this gradual approach, he ensured adherence to fiscal consolidation as recommended by FRBM report on fiscal consolidation road map. If this road map needs to be achieved, then achieving the targeted revenue is inevitable, and achieving the fiscal target revenue may be possible only by implementing GST (to achieve the targeted Indirect Tax Revenue based on GST) at earliest. We are presuming that the Government is zealous about maintaining the Fiscal discipline and implementing GST on time.

Further one can also predict that Indirect Tax revenue growth of 8.8% in the first year of implementation is not easy for the Government to achieve, that too within 9 months. We are presuming here that the Government will not only implement GST on time, but with vigour, and expect high compliance from businesses.

With all this, there are enough and more indications from the Government that it is keen to implement GST from 1st of July 2017. Mr. Jaitley’ s statement in the Budget Speech that he does not prefer to make many changes in the current regime of Excise & Service Tax because the same are to be replaced by GST soon is like the icing on cake.

Therefore, it is time for businesses to gear up for GST readiness since GST transformation is not an overnight affair.

आम आदमी को जीएसटी से होने वाले 10 फायदे

1. जीएसटी लागू होने पर सबसे ज्यादा फायदा आम आदमी को है. क्योंकि तब चीजें पूरे देश में एक ही रेट पर मिलेंगी, चाहे किसी भी राज्य से खरीदें. रोज़मर्रा के जीवन में इस्तेमाल की जाने वाली वस्तुएं जैसे कि मोबाइल हैंडसेट, कार, सिगरेट, शराब, आदि गुड्स में शामिल हैं तो गुड्स एंड सर्विसेज टैक्स लागू होने के बाद इनके दामों में बड़ा बदलाव हो सकता है और पूरे देश में एक समान दरें लागू होंगी.

2. जीएसटी के लागू होने के बाद टैक्स चोरी रुक जायेगी. इसका सीधा असर देश की जीडीपी पर पड़ेगा. फिलहाल भारत देश में 20 तरह के टैक्स लगते हैं और जीएसटी आने के बाद सब टैक्स हटकर एक टैक्स लागू होगा, वो है जीएसटी.

3. आम जनता जो अभी सामान खरीदते वक्त उस पर 30-35% टैक्स के रूप में चुकाते हैं. जीएसटी लागू होने के बाद ये टैक्स घटकर 20-25% रहने की उम्मीद है तो इसका सबसे बड़ा फायदा आम जनता को ही मिलेगा.

4. जीएसटी लागू होने पर कंपनियों का झंझट और खर्च भी कम होगा. व्यापारियों को सामान एक जगह से दूसरी जगह ले जाने में कोई दिक्कत नहीं होगी. अलग-अलग टैक्स नहीं चुकाना पड़ेगा तो सामान बनाने की लागत घटेगी, इससे सामान सस्ता होने की उम्मीद भी है.

5. राज्यों को डर ये था कि उनकी कमाई कम हो जाएगी. खासकर पेट्रोल डीजल से तो कई राज्यों का आधा बजट चलता है. तो वो राहत केंद्र ने राज्यों को दे दी उनपर अभी जो टैक्स राज्य ले रहे हैं, वो शुरुआती बरसों में लेते रहें. और राज्यों का जो नुकसान होगा उसकी भरपाई पांच साल तक केंद्र सरकार करेगी. इसके अलावा जीएसटी से जो टैक्स मिलेगा, वो केंद्र और राज्य में एक तय हिसाब से बंटेगा.

6. उदाहरण के लिए दिल्ली से सटे नोएडा, गुड़गांव वाले जो कभी गाड़ी यूपी से लेते हैं, कभी हरियाणा या कभी दिल्ली से, जहां भी सस्ती मिल जाए वहां से लेते हैं तो जीएसटी आने के बाद ऐसी कोई बंदिश नहीं रहेगी.

7. फिलहाल देश में गुड्स और सर्विसेज टैक्स की दरें अलग-अलग हैं जैसे सर्विस टैक्स 15 फीसदी है और गुड्स यानी वस्तुओं के लिए अलग-अलग राज्य में अलग दरें लागू होती हैं जो जीएसटी आने के बाद एक जैसी हो जाएगी.

8. जीएसटी लागू होते ही केंद्र को मिलने वाली एक्साइड ड्यूटी, सर्विस टैक्स सब खत्म हो जाएंगे. राज्य सरकार द्वारा लिए जाने वाला वैट, एंटरटेनमेंट टैक्स, लग्जरी टैक्स लॉटरी टैक्स एंट्री टैक्स, चुंगी आदि सभी तरह के स्टेट टैक्स खत्म हो जाएंगे.

9. जीएसटी लागू होने के बाद कंपनियों का खर्चा और लागत कम होंगे क्योंकि सामान एक जगह से दूसरी जगह ले जाने में कोई दिक्कत नहीं होगी. कंपनियों को अलग-अलग टैक्स ना चुकाने की वजह से उनकी लागत कम होगी लिहाजा सामान सस्ते होंगे.

10. जीएसटी आने के बाद टैक्स ढांचा एकदम समान होगा और पूरी तरह पारदर्शी होगा जिससे टैक्स विवाद नहीं होंगे और ढेरों टैक्स कानून और टैक्स नियामकों (रेगुलेटरों) का झंझट नहीं रहेगा. इससे एक ही संस्था, कंपनी, व्यक्ति पर कई बार टैक्स लगाने की दिक्कत खत्म हो जाएगी. कुल मिलाकर आम आदमी, कारोबारियों और सरकारों की जिंदगी बेहद आसान हो जाएगी.

11. साल 2014 में पास संविधान के 122वें संशोधन के मुताबिक जीएसटी सभी तरह की सेवाओं और वस्तुओं/उत्पादों पर लागू होगा. सिर्फ अल्कोहल यानी शराब इस टैक्स से बाहर होगी.

जीएसटी का इतिहास
इससे पहले, जीएसटी विधेयक को 2011 में लोकसभा में पेश किया गया था लेकिन लोकसभा का कार्यकाल समाप्त होने के साथ ही विधेयक निरस्त हो गया. इससे नई सरकार को नया विधेयक लाना पड़ा है. सर्वप्रथम 2006-07 के बजट में तत्कालीन वित्त मंत्री पी. चिदंबरम ने जीएसटी का विचार आगे बढ़ाया था. शुरू में इसे एक अप्रैल 2010 को लागू किया जाने का प्रस्ताव था लेकिन फिलहाल ये तारीख आगे खिसक चुकी है. इस मानसून सत्र में जीएसटी बिल पास होने की उम्मीद है और अगर ऐसा हो जाता है तो देश के टैक्स ढांचे में आमूलचूल बदलाव आएगा जो अर्थव्यवस्था के लिए आखिरकार फायदेमंद साबित होगा.

प्रदानमंत्री नरेंद्र मोदी ने भी विपक्ष से अपील की है कि देशहित के लिए इस बार के मानसून सत्र में जीएसटी पर चर्चा होने दी जाए और बिल पर व्यापक चर्चा के बाद इसे पास होने के बाद इसे पास कराने का रास्ता निकाला जाए.

Economists have started to downgrade their forecasts for UK growth.

The pound has now slumped by an unprecedented 11% against the dollar.

The Financial Times reports Standard & Poor's saying the UK is likely to lose its AAA credit rating.

Calls are coming in for Prime Minister David Cameron to step down.

Ukip MP Douglas Carswell said: 'I suspect that David Cameron is now pondering the possibility of stepping down.'

Labour MP John Mann said: "Today is about Cameron resigning. Cameron has got to go today. He has no credibility left whatsoever. He is the most unpopular person out there.'

Ukip leader Nigel Farage said that Mr Cameron should step down 'immediately' in the event of a Leave victory.
