Justice Anupinder Singh Grewal Appointed President of NCLT

The Appointments Committee of the Cabinet has approved the appointment of Justice Anupinder Singh Grewal as the President of the National Company Law Tribunal (NCLT).

A former judge of the Punjab and Haryana High Court, Justice Grewal succeeds Justice Ramalingam Sudhakar and will hold office for a tenure of up to five years.

BOUNCED CHEQUE ≠ AUTOMATIC LIABILITY

Most people — including a lot of lawyers — get this wrong.

They assume:
Cheque bounced → Case under Section 138 of the Negotiable Instruments Act → Liability proven.

That’s sloppy thinking.

Here’s the reality:

A cheque is not the liability.
It’s just a piece of evidence.

👉 Liability exists only if there is a legally enforceable debt behind that cheque.

THE COMMON MISTAKE

“Cheque bounce means I’ll win.”

No.
If the underlying transaction is weak, your case is weak.

WHAT ACTUALLY MATTERS

To succeed, you need to prove:

✔ There was a real transaction
✔ There was an existing liability
✔ The cheque was issued in discharge of that liability
✔ The amount matches the actual debt

WHERE CASES COLLAPSE

Most 138 cases fail because:

- Cheque was given as security
- No proper documentation of transaction
- Debt is time-barred
- Amount is inflated or inconsistent
- No clear proof of liability

And once the accused creates doubt, the presumption under Section 139 of the Negotiable Instruments Act starts crumbling.

The Telangana High Court recently delivered a significant ruling against the HYDRAA Commissioner, finding the official in contempt of court for defying a previous legal mandate regarding land in Amberpet.

Although the court deemed imprisonment and fines unsuitable, it invoked the principle of restitutive justice to address the unlawful occupation and alteration of the seven-acre site.

The Commissioner is now legally required to remove all structures, gates, and signs that falsely designate the private area as public property.

These restoration efforts must be completed within a four-week deadline to ensure the land returns to its prior status.

By focusing on reparation over punishment, the bench aims to restore the petitioner's rights while avoiding further physical damage to the terrain. The final outcome of this dispute remains contingent upon a pending Civil Miscellaneous Appeal.
