Key Tax Rules Every F&O Trader Must Know:
It is Business Income: Unlike standard stock investments, the Income Tax Department classifies F&O trading as Non-Speculative Business Income, not Capital Gains.
The Right ITR Form: Because it is treated as business income, you must file your returns using ITR-3 (or ITR-4 if you opt for the presumptive taxation scheme under section 44AD).
Taxed at Slab Rates: Your net profits from F&O trading are added to your total income (along with salary, rental income, etc.) and taxed according to your applicable income tax slab rate.
Claim Your Expenses: You can significantly reduce your taxable profit by claiming legitimate business expenses! Deductible expenses include brokerage charges, STT, exchange fees, internet bills, trading software subscriptions, and advisory fees.
Smart Loss Management: Did you incur losses? You can set off F&O losses against other business income (excluding salary) in the same financial year. Even better, you can carry forward unadjusted losses for up to 8 years to offset future F&O profits, provided you file your ITR on time.
Tax Audit Applicability: A CA tax audit is generally mandatory if your trading turnover exceeds โน10 Crore (for 100% digital transactions). If your turnover is less than โน10 Crore but your declared profit is less than 6% (and total income exceeds the basic exemption limit), an audit may also be required.
