*आयकर प्रावधानों में TCS संबंधित महत्वपूर्ण बदलाव*

*अब आपको अपनी बिक्री पर 01 अक्टूबर 2020 से TCS Collect करने की आवश्यकता होगी.*

*प्रश्न-* यह प्रावधान किस करदाता पर लागू होगा ?
*उत्तर-* उपरोक्त प्रावधान सभी करदाताओं जिनका की वित्त वर्ष 2019-20 में कुल बिक्री (Total Sale) 10 करोड़ से अधिक है, उन पर लागू होगा.
यदि ऐसे करदाता किसी एक खरीददार को वित्त वर्ष में 50 लाख से ज्यादा का माल बेचते हों, तो 50 लाख से ऊपर की बिक्री पर *बिल में ही* TCS Collect करके गवर्नमेंट को जमा कराना होगा.

*प्रश्न-* TCS की Rate क्या होगी ?
*उत्तर-* TCS की Rate 1 अक्टूबर 2020 से 31 मार्च 2021 तक @0.075 % होगी. 1 अप्रैल 2021 से @0.1% होगी (यदि खरीददार के पास Valid PAN हो तो) अन्यथा @5% से TCS Collect करना होगा.

*प्रश्न-* विक्रेता की उपरोक्त प्रावधानों के लिए क्या-क्या जिम्मेदारी है ?
*उत्तर-* विक्रेता को बिक्री पर विक्रय बिल में TCS Charge करना होगा और ऐसे TCS को Govt. Treasury में जमा कराना होगा. *उसके पश्चात TCS की Return भी भरनी होगी.*

*प्रश्न-* TCS को Govt. Treasury में कब जमा कराना है ?
*उत्तर-* TCS को क्रेता से पेमेंट मिलने पर जमा कराना है. अतः TCS जमा कराने का दायित्व Collection Basis पर है ना कि Bill Basis पर.

*प्रश्न-* यदि 30 सितंबर 2020 तक किसी क्रेता को 50 लाख तक की बिक्री की है और उसके पश्चात 1 अक्टूबर से 31 मार्च 2021 तक 10 लाख की बिक्री की है तो TCS किस राशि पर जमा कराना है ?
*उत्तर-* TCS 50 लाख से ऊपर की राशि 10 लाख पर ही जमा कराना है.

*प्रश्न-* TCS को बिल में कहां और कैसे दर्शाना है और इसका GST पर क्या प्रभाव पड़ेगा ?
*उत्तर-* TCS को बिल में GST Charge करने के पहले दिखाना है और GST, Sale Value + TCS की Amount पर चार्ज किया जाएगा.

As on 25/01/2018, the following 13 States have issued notification for introducing E-waybill w.e.f. 1st February, 2018 for INTRA-STATE (within state) movement of goods having consignment value exceeding ₹50000.

5) Jharkhand
6) Karnataka
7) Kerala
8) Puducherry(UT)
9) Sikkim
10)Tamil Nadu
11)Telangana
12)Uttar Pradesh, and
13)Uttarakhand

Also, the following states have issued notification for introduction of e way bill from a deferred date as given below:

14) Odisha - 01/06/18
15) Maharashtra - 01/05/18
16) Chattisgarh - 01/06/18
17) West Bengal - 01/06/18

Note: E-WAYBILL is mandatory in all States/UT for inter-state movement of goods w e.f. 01/02/18.

Proposal at 21st GST Council meeting at Hyderabad
New time table for filing returns
1. GSTR-1 (for the month of July 2017) 10.10.2017
2. For registered persons with aggregate turnover in a state more than Rs. 100 crores., The due date for GSTR-1 for July 2017 will be 03.10.2017
3. GSTR-2 (for the month of July 2017) 31.10.2017
4. GSTR-3 (for the month of July 2017) 10.11.2017
5. GSTR-4 (for the quarter July-sep 2017) 18.10.2017
6. Table 4 under GSTR-4 not to be filed for the quarter july-september 2017. Requirement of filing GSTR-4 for this period to be dispensed with.
7. GSTR-6 (for the month of July 2017) 13.10.2017
8. Due dates for filing of the above-mentioned returns for subsequent periods shall be notified at a later date.
9. GSTR-3 B will continue to be filed till for the month of December 2017.

And 125,000 retired Income Tax officers aged 58-61 years have been recalled by Modi. They have 3 day training from 28-30 Nov and join work on 1 Dec. What work they will do is anyone's guess.

According to a retired income tax commissioner this is how the Government plans to remove black money from India ?

Step 1 : Demonetise Rs.500 and Rs.1000. get Rs.1420000 crores out of the market.

Step 2 : Print Rs.2000 and Rs.500 and Rs.100 in the replacement market.

Step 3 : Dismantle the cash economy by not allowing any cash transaction above Rs.10000 without PAN or Aadhar.

Step 4 : All salaries and business expenses required to be made in cheque or RTGS only to claim expenses in Income Tax. All cash transactions to be disallowed.

Step 5 : A Cash Limitation order will be issued that will allow only maximum cash allowance of total Rs.50000 per person.

Step 6 : As the cash economy is destroyed after a few months, the Rs.2000 note will be demonetised with a limited notice.

With very limited cash available in the market, the cash economy will be strangled to death.

Step 7 : As some of the cash economy will try to shift to Gold, Gold coins manufacturing and imports will be banned.

Step 8 : A Gold and Precious Jewellery control order will be issued which will allow only 500 gram of Gold per person and a certain value of other jewellery. Relaxation will be given for existing jewellery if declared to authorities as per format. After a certain date, all undeclared Gold and jewellery will be liable to be taken over by the state.

Step 9 : A Property and Asset Declaration order will be issued where all property (Land, Buildings and Flats) and shares will have to be declared to the authorities in a particular format. After a certain date, all undeclared property or shares will be liable to be taken over by the state.

That will complete the removal of black money from India.
u can plan appropriately before its too late.
