पैरामिलिट्री फ़ोर्स के अलवा निजी स्तर पर सुरक्षा गार्ड उपलब्ध करवाए जाते हैं। जिसके लिए ‘प्राईवेट सिक्योरिटी एजेन्सी रेगुलेशन ऐक्ट, 2oo5 “पसारा” बनाया गया, अंगर्तगत राज्यों को लाइसेंस व नियम बनाने की शक्ति दी हुई है। वर्तमान परिप्रेक्ष्य में प्राइवट सिक्योरिटी गार्ड की डिमांड कई गुना बढ़ी है, ऑफ़िस, फ़ैक्टरी, गोदाम, स्कूल, हॉस्पिटल, बैंक, एयरपोर्ट, बंदरगाह, राजीव गाँधी सेवा केंद्र, अटल सेवा केन्द्र, गेट बंद कॉलोनी, बहुमंज़िला इमारतों, कन्स्ट्रक्शन साइट्स, टोल टैक्स, रेस्टोरेंट, कोरपोरेट ऑफ़िस, शॉपिंग मॉल, मेट्रो ट्रेन,स्कूल कॉलेज,बैंक, atm, बंगला, कोठी इत्यादि पर सुरक्षा गार्ड तैनात किए जाते हैं। कोई भी सिविलियन व्यक्ति सुरक्षा एजेन्सी खोलकर अपना व्यवसाय संचालित कर सकता हैं।

*MCA Update*

In our continuous endeavour to serve you better, the *Ministry of Corporate Affairs is launching Second set of Company Forms*

*covering 56 forms in two different lots on MCA21 V3 portal.*

*10 out of 56 forms will be launched on 09th January 2023 at 12:00 AM*
and the *remaining 46 forms on 23rd January 2023.*

*Following forms will be rolled-out on 09th January 2023*:

_SPICe+ PART A, SPICe+ PART B, RUN, AGILE PRO-S, INC-33, INC-34, INC-13, INC-31, INC-9 and URC-1._

Click here to view list of 46 forms which will be rolled-out on 23rd January 2023.

To facilitate implementation of these forms in V3 MCA21 portal, *stakeholders are advised to note the following points:*

*_(1) Company e-Filings on V2 portal will be disabled from 07th January 2023 12:00 AM to 08th January 2023 11:59 pm for 10 forms which are planned for roll-out on 09th January 2023._*

*(2) Company e-Filings on V2 portal will be disabled from 21st January 2023 12:00 AM to 22nd January 2023 11:59 pm for 46 forms which are planned for roll-out on 23rd January 2023.*

*(3) All stakeholders are advised to ensure that there are no SRNs in pending payment and Resubmission status.*

*(4) Offline payments for the above 56 forms in V2 using Pay later option would be stopped from 28th December 2022 12:00 AM.*

You are requested to make payments for these forms in V2 through online mode (Credit/Debit Card and Net Banking).

*(5) In view of the upcoming launch of 56 Company forms, V3 portal will not be available from 07th January 2023 12:00 AM to 08th Jan 2023 11:59 pm due to 10 company forms roll-out and from 21st January 2023 to 22nd January 2023 for 46 company forms roll-out.*

*(6) V2 Portal for company filing will remain available for all the forms excluding above mentioned 56 forms.*

Stakeholders may plan accordingly.

*भारत सरकार द्वारा ई-बाज़ार ई-कॉमर्स*
यह तोड़ना अगस्त 2016 में वस्तुओं और सेवाओं को ख़रीदने व बेचने की अनुमति देता है। पूर्व में यह DGS&D के नाम से सरकारी ख़रीद वाली एजेंसीयों को लिस्टेड व नियमन का कार्य करती थी। कोई भी भारतीय व्यक्ति, फ़र्म, कम्पनी ई-कोमर्स प्लेटफ़ार्म जेम के साथ जुड़कर बिज़नेस कर सकता है। GeM का लक्ष्य सार्वजनिक ख़रीद में पारदर्शित, दक्षता और गति बढ़ाना है। ई-कोमेर्स मार्केट का कारोबार दुनियाभर में दिन दुना, रात चौगुनी गति से बढ़ रहा है। इसलिए सरकार ने भी ग़वरमेंट ई-मार्केटप्लस, जिसका संक्षिप्त नाम GeM है। किसी भी सरकारी डिपार्टमेंट हों या मिनिस्ट्री हो, केन्द्र व राज्य सरकार को किसी भी उत्पाद की आवश्यकता पड़ती है तो वह GeM पोर्टल से ही ख़रीदा जाता है।

ख़ास बात यह कि केन्द्र सरकार के इस अभियान के तहत बुनकर और कारीगर, सूक्ष्म उद्यमियों, महिलाओं, आदिवासी उद्यमियों और स्वमं सहायता समूहों आदि विक्रेता समूहों की भागीदारी बढ़ी है।इसमें फ़र्नीचर, मेडिकल सहायक उपकरण, चिकित्सा, हस्तशिल्प, हैंडलूम, टेक्सटाइल,अग्नि सुरक्षा उपकरण, कम्प्यूटर, सुरक्षा जनशक्ति, कैटरिंग, मानव संसाधन सहित 41,98,633 उत्पाद एवं 46,23,230 विक्रेता और सेवा प्रदाता पंजीबद्ध हैं।

बौद्धिक सम्पदा अधिकार IPR के अंतर्गत ‘Design Act, 2000’ में आपके द्वारा तैयार किसी भी डिज़ाइन के सर्वाधिकार सुरक्षित व क़ानूनी अधिकार प्रदत्त होते हैं। जैसे - पार्कर पैन, रेबैन का चश्मा, गाड़ियों, घड़ियों, बैग, जूतों, कपड़ों की डिज़ाइन यदि रजिस्टर्ड है तो कोई भी आपके उत्पाद की कॉपी नहीं कर सकता है।
डिज़ाइन आवेदन करने से पूर्व उत्पाद के वर्गीकरण की क्लास का चयन किया जाता है।
डिज़ाइन का प्रमाण पत्र की वैधता दस वर्ष की होती है। इसके। आस इसे पुनः पाँच वर्षों के लिए नियमानुसार रेनूअल किया जा सकता है।
डिज़ाइन एक्ट में किसी भी उत्पाद का भौतिक होना ज़रूरी है उसके फ़्रंट, बैक, टॉप, बॉटम से कैसा दिखता है? उसकी माप इत्यादि का चित्र व विवरण की आवश्यकता होती है।
डिज़ाइन एक्ट के तहत सम्पूर्ण भारत की रोलिंग रजिस्ट्रार ओफ़ डिज़ाइन, कोलकाता के समक्ष प्रस्तुत की जाती है।

MAIN FEATURES OF SECTION-8 MICRO FINANCE COMPANY
• RBI approval is not required.
• No need of minimum capital of Rs. 5 Crores.
• Minimum Compliances.
• Can give unsecured loan to small business of Rs. 50,000.
• Can give loan for dwelling residence up to Rs.1.25 lakhs.
• Section-8 Micro Finance company have to follow the RBI guidelines on interest rate and processing charges.
• It is a legal finance business and you can sue the defaulter in case of non-payment of loan amount.
• The Reserve Bank of India through its master circular RBI/2015-16/15 DNBR (PD) CC.No.052/03.10.119/2015-16 Dated July 01 2015 has exempted all Section 25 Companies (Now Section 8 of CA, 2013) engaged in micro finance activities.
• According to above mentioned circular Sections 45-IA, 45-IB and 45-IC of the Reserve Bank of India Act, 1934 shall not apply to any non-banking financial company which is engaged in below mentioned activities.
• Engaged in micro financing activities, providing credit not exceeding Rs. 50,000 for a business enterprise and Rs. 1,25,000 for meeting the cost of a dwelling unit to any poor person for enabling him to raise his level of income and standard of living; and.
• Licensed under Section 25 of the Companies Act, 1956 / Section 8 of the Companies act 2013.
• Not accepting public deposits as defined in paragraph 2(1) (xii) of Notification No. 118 /DG (SPT)-98 dated January 31, 1998.

MCA has notified the Companies (Incorporation) Amendment Rules, 2022 which shall come into force from the date of their publication in the Official Gazette i.e 08-04-2022. Amendments are carried out in Rule 12 of the Companies (Incorporation) Rules, 2014 to insert a new proviso to provide that in case of a Company being incorporated as a Nidhi, the declaration by the Central Government under Section 406 of the Act shall be obtained by the Nidhi before commencing the business and a declaration in this behalf shall be submitted at the stage of incorporation by the company. Through this amendment Form INC – 20A is also revised to specifically capture the notification declaration as a Nidhi Company as one of the mandatory attachments.

Company Secretary Exam : CS Student Moves Supreme Court To Direct ICSI To Retain Old Syllabus Attempt Till December 2022
A student pursuing CS has approached Supreme Court seeking the extension of old syllabus attempt till December 2022. Preferred by Aditya Vikram Singh as petitioner in person, it has been argued that some students were unable to give exam due their helplessness and some family problems and now old syllabus.

The filing of AOC -4, AOC-4 (CFS), AOC- 4 XBRL, AOC – 4 Non-XBRL up to 15.03. 2022 Without additional fee, if not filed till 15.03.2022. Late fee will be calculated from the date originally date on which forms were required to file. Late fee Rs. 100 per day.
