Big relief to the Industry:

Today, Gujarat High Court has pronounced order on Ocean freight. Levy of GST on Ocean freight held ultra virus.

Therefore, No tax is leviable under the Integrated Goods and Services Tax Act, 2017, on the ocean freight for the services provided by a person located in a non-taxable territory by way of transportation of goods by a vessel from a place outside India upto the customs station of clearance in India and the levy and collection of tax of such ocean freight under the RCM Notifications is not permissible in law.

u/s 49 as specified in “Section 98”of the Finance (No. 2) Act, 2019 (23 of 2019) now notified to be applicable from 1st Jan 2020 vide notification no. 01/2020- central tax, dated 01.01.2020.

Please note that the said form “GST PMT-09” yet to enable at GST portal.

73% taxpayers availed Sabka Vishwas, commit Rs 30627 Cr, date extended upto 15 Jan.

New Delhi: Sabka Vishwas (Legacy Dispute Resolution) Scheme has received a huge response with almost 73% of the total eligible taxpayers availed the Scheme and have committed to pay tax dues of Rs. 30,627 Crores. Keeping in view the response of the taxpayers to the Scheme, the Central Government today *extended it for a period of fifteen days, till 15th January, 2020*.

This is one-time and final extension in view of taxpayers’ response.
CBIC said today that out of the total 1.84 lakh taxpayers who are eligible to avail the Scheme, as many as 1,33,661 taxpayers have so far submitted their applications by the morning of 31.12.2019. Their applications involve tax dues of Rs. 69,550 Crores and after availing various reliefs, the payable amount is Rs. 30,627 Crores. Sabka Vishwas is received by the taxpayers as the most beneficial dispute resolution scheme ever announced by the Government.

*Therefore, the Government has extended the SVLDRS as a one-time measure for a fortnight up to 15.01.2020. There will be no further extension to this Scheme, CBIC reiterated*

*Standard Opersting System (SOP) for non filiers of returns under GST & their cancellation of registration*

1. Registered persons under GST will get a reminder 3 days before due date to file their GST returns;

2. Once the due date is over, the registered person will get a msg from gst dept stating that he has not filed the said return;

3. 5 days after the due date is over, the registered person will get a notice in form GSTR3A requiring him to furnish the said return within 15 days;

4. If the person doesn't file the return within 15 days, the officer will pass a best judgement assessment order in form GST ASMT 13;

5. Now, the registered person gets a final opportunity to submit his return within 30 days from passing the above order, if he files then the order will stand withdrawn. If he doesn't, then the officer will start recovery proceedings for recovery of GST.
