Today's feedback of the day goes back to circa 2003 and the trend of making improvements for employers and client's alike has continued to this day. Not everyone appreciates change or being told that things can be improved but, if you want improvement you must embrace change and that change must receive support from those at the very highest level of the business.

Some of the feedback I have been fortunate enough to receive over the years. I remember the case that this feedback refers to and I remember it very well. The opponent's solicitors were quite an aggressive bunch and the debtor representative was quite "cocky".

I distinctly remember one of the meetings with him and his solicitors which I fondly remember as what I can only describe as an attempted ambush. It was evident that I had been identified as the "week link". I think the London solicitors soon realised that with a West of Scotland upbringing, I was far from the weekest link 😁.

I May not have a law degree but, I knew the facts, the evidence and in their case, the lack of evidence. I can look back fondly on that meeting with a smile.

It might be too simplistic an idea but, businesses know their tax obligations so, why not ring fence funds to pay for them rather than use as working capital ? VAT is payable on sales so if sales are paid for then that is HMRC's money not for the business to use. As I say, maybe too simplistic an idea but, I certainly set cash aside for tak liabilities rather than working capital.

I need to admit that this one has left me confused! A construction contract does not need to be in writing per the construction act but, adjudicator did not have jurisdiction because there was no contract or a dispute over which contract governed the works.

One thing is clear (aside from if work was done it should be paid for irrespective of legal arguments) formation of contracts verbally or via WhatsApp / text clearly lead to problems further down the line.

This contractor will probably need to go to trial, I presume that they will need to pay adjudicator's costs (no mention in the article of what happens on costs if a court refuses summary judgement but, no doubt the adjudicator made both parties liable for costs but, if he did not have jurisdiction...) legal costs and more costs to get to trial. It highlights yet again the importance of due diligence, have contracts in writing and throughly checked before starting work.

If course, the age old issue of the employer wanting you to start work tomorrow will remain as will the contractor seeing 💷 signs and hoping no issues and they will be paid.

This will be a bit hard to take for the businesses impacted. It's very easy to sit and look in from the outside and say credit control should have been implementing tight control, reduced credit limits, stopped supplies etc. But, more often than not, credit control have NO control as they are overruled, ignored and seen as sales prevention department.

Good credit control is vital to all businesses irrespective of business size. The clue in credit control is CONTROL and that is not just chasing overdue debt.

Credit Control has to have 'control'. This point is often overlooked by companies that push every sale and 'wait and hope' for debtors to pay invoices on time.

The 'control' does not start with receiving an order, or whatever procedure is used to notify credit control of new customers. The control must start with a level of authorisation/involvement in agreeing real-time credit terms: sales staff sell, Commercial department review contracts and set up new accounts and credit control, controls the credit and ultimately the risk to the company of granting credit.

Administrators have revealed almost 500 firms are owed money by Brewdog after the collapse of the Scottish drinks giant.

Delighted to have collected just over 4k debt including costs and interest. The debtor claimed they had cash flow issues, started ignoring the client, I got on the case and cited cash flow issues.

They proposed a payment plan over 4 months which the client rejected.

I advised the client was not prepared to accept the payment plan and I was ignored. I then told them what I was going to do via escalation if payment was not made by 10am this morning. Payment was made at 9am!

Clearly they had the money to pay but, wanted to use my client as a lender in order to improve their cash flow. Full credit to the client for insisting on payment in full.

Due diligence - know your customer and in construction, know your customers customer. Water tight contract and payment terms and escalate quickly if delays in payment.

Monitoring of your customer is also very important but, alas, sometimes you only get alerted to negative situations such as court judgments or insolvency but, in terms of negative information it gives you that chance to reduce the risk of significant losses.
