Thinking of filing a DS01 to strike off your company?

If your business has outstanding debts, creditor pressure, or HMRC arrears, a DS01 may not be the right solution. Filing for voluntary strike off when a company is insolvent can lead to objections, investigations, and potential director consequences.

Before taking action, it’s important to understand the difference between:

✔️ A voluntary strike off (DS01)
✔️ A Creditors’ Voluntary Liquidation (CVL)
✔️ Your duties as a company director

Seeking advice early can help protect your position and ensure the correct process is followed.

At DCA Business Recovery, we provide clear, confidential advice to directors facing financial pressure.

Worried about a Bounce Back Loan?

If your company is struggling, it is important to understand what happens to the loan if the business enters insolvency.

In most cases, a Bounce Back Loan is a company debt — not a director’s personal debt. But directors can still face problems if the funds were misused, false information was given, assets were moved improperly, or the company was dissolved to avoid repayment.

The loan does not simply disappear in liquidation or administration. The lender will usually claim in the insolvency process.

The safest step is to get advice early and keep clear records of how the loan was used.

Dca Business Recovery can help you understand your options and what to do next.

General information only — specific advice depends on your circumstances.

A County Court Judgment can affect your company’s reputation, credit profile, and future trading.

Ignoring the situation can lead to further legal action.

Can a director buy company assets back after liquidation?

Yes — sometimes they can.

But it has to be done properly.

In a CVL, the liquidator takes control of the company’s assets and must act in the interests of creditors.

If a director or connected party wants to buy assets, the sale must be fair, documented, and capable of standing up to scrutiny.

The liquidator also needs to report any connected party sale to creditors in the next report.

Assets are not simply handed back because a director used them before liquidation.

Buying assets back may be possible — but it needs to be transparent and creditor-focused.

Thinking of closing your company with a DS01?

A DS01 can be useful when a company has stopped trading and everything has been properly dealt with.

But it is not a shortcut for insolvency.

If the company owes money to HMRC, suppliers, lenders or other creditors, using a DS01 could cause problems.

Creditors can object.
The application can be stopped.
The company may be restored later.
Directors may face scrutiny.

If the company is insolvent, a formal liquidation process is usually the safer route.
