Did you know that in cases of simultaneous death if it can't be determined who died first then it will be deemed to be the eldest for inheritance purposes?

This may not cause a problem for many but if the parties involved are in their second marriage and have not updated their Will, then all of the assets from the home could pass to one of them and then on to that person's children leaving out the children of the other person.

For example, a recently married couple have one child each from their first marriage and die in a car accident. It was impossible to say who died first so it is deemed the husband that the husband died first as he is the oldest. As each of them left their estate to each other if one died then this means the estate would go to the wife and then be passed to her beneficiaries being her only child and leaving the husbands child with nothing.

An effective will could stop this from happening so making sure your Will is updated with any change of circumstances is vital.

It is important to review your will regularly, as both your situation and your appointed guardians’ situations, may have changed.
