"We don't need a Lasting Power of Attorney yet." Something people/clients quite often say...🙈

That's great news! But what happens when you do need it and it's too late to make one? With LPA's you are only able to make one whilst you still have mental capacity 😢

Loss of mental capacity can be caused by things like Alzheimer's, dementia, head injury etc.

If you don't make one and you need one, your family will have to apply to the Court of Protection for deputyship. This can take years to complete and can cost several thousand pounds.

Don't leave it until you need it - make one now and hope that you never need to use it, and know that if you do need it, you're already covered 👏

So how do you set up a Lasting Power of Attorney?

Here's our answer:

There are a number of forms and documents that need to be completed and submitted to the Office of the Public Guardian which exists to protect people who have lost mental capacity.

The process involves three people. The person who the LPA is for, the attorney (in this context the person who is legally appointed to act on behalf of the person to whom the LPA applies) and another person known as the certificate provider who witnesses that the decision has been made with the understanding and agreement of the person who the LPA applies to.

There is no guidance from the OPG on how to complete the application forms even though they need to be completed and signed in a particular order. So it’s best to get advice on how to complete them so that they aren’t returned.
