I was invited to speak on a panel about the FCA's new Non-financial Misconduct rules in London at Judd Advisory's 'Navigating Compliance' conference earlier this week.

Interesting content throughout the day, a great crowd asking intelligent questions, fabulous co panelists and presenters, including Emily Shepperd (former COO of the FCA) and warm hospitality from Judd Advisory.

The latest whistleblowing quarterly data from the FCA is a reminder to firms that their culture (or lack of it) is a regulatory risk.

What's concerning is that the top 10 whistleblowing allegations point to culture, including 'leadership and senior managers: behaviour, conduct and integrity' which sits at number 2 on the chart.

Alongside this, non-financial misconduct also features in the top 10. This is a wake up call to firms that are planning on only just 'ticking the box' in respect of the new Non-financial Misconduct rules and aren't seeing the bigger picture.

It'll be interesting to see how these patterns change at the end of the next quarter, by which time the new Non-financial Misconduct rules will have come into play.

If you belong to an FCA authorised firm, make sure that your Board gets to see this data. They might thank you for it further down the line.

The sun was shining yesterday in London when we held our Non-financial Misconduct event for authorised firms, in conjunction with Mishcon de Reya LLP and PeopleClear.

Following the keynote from FCA's Peter Curtis-Valino, we explored NFM from a range of perspectives, including case scenarios that prompted engaging discussion.

The session brought the topic together in a practical way, highlighting the more subtle elements that are critical to effective implementation ahead of September's deadline.

Crucially, our key focus was to highlight the need for firms to implement the new requirements with a joined up approach between Compliance / HR / Legal and underpinned by Culture.

We can't wait for Tuesday!

Non-financial Misconduct isn’t just a Compliance issue, it’s also HR, it’s Legal and it's Culture. So what's the problem? Well, too many firms are (worryingly) tackling it in silos.

With the September 2026 deadline approaching, we’re seeing firms focus on individual pieces of the puzzle, without joining them up.

That’s exactly why we’re co-hosting this event next week, in collaboration with Andrew Pullman from PeopleClear & Adam Epstein and Elizabeth Hope from Mischon de Reya LLP (and kindly hosted at Mischon de Reya's offices), in London.

Principles and ARs, you have some weekend reading!

A consultation was issued by HM Treasury yesterday and invites responses (with a closing date of 8th April 26) to proposed changes to the AR Regime.

The Regime has always been fraught with challenge and was enhanced in December 2022, which seems like an age ago now.

The purpose of this Consultation is 3-fold:
To help to prevent misconduct involving ARs.
To ensure that consumers are protected when things go wrong.
To align AR conduct and fitness & propriety to that of regulated firms.

You'll find plenty of posts about this on LinkedIn, but as always I'd advise you to review the Consultation directly so that you don't miss any details that could be relevant to your firm.

Our monthly online professional development sessions at The Culture Space for senior managers always bring up some really thoughtful insights from our members.

Yesterday we explored the role that SMFs play in creating an environment where people feel safe enough to speak up and challenge. We also talked about how important it is to look beneath the surface when something goes wrong, rather than just reacting to the incident itself.

One member shared a great example. Their firm regularly holds town hall meetings. Each team had strong discussions and healthy challenge within their department but when it came to the town hall itself, everyone was quiet.

At first they assumed it was down to employees feeling a bit intimidated by the CEO, but they spoke with each team and realised that this wasn't true, instead, they simply hadn’t felt prepared enough to contribute.

So the firm changed its approach.

Now the agenda and some background context are shared in advance. Teams hold a short, facilitated session beforehand so employees can shape their thoughts and raise questions collectively. Those are then brought forward to the town hall.

At the next session, engagement increased significantly. Once the initial questions were asked, more people began to build on them. Leaders gained a clearer understanding of how their people really felt and employees felt heard rather than simply 'spoken to'.

As with most culture change, it’s rarely the sweeping changes that shifts this kind of dynamic, it’s the small, thoughtful actions taken consistently that make a real difference.

These kinds of practical, real-world conversations come up often in The Culture Space, where senior managers share what’s working (and what isn’t) in their organisations. If you’re an SMF, you’d be very welcome in the discussion.

We're still at the beginning of January and already the FCA has published it's first Final Notices of 2026.

This time, for Mr Khan and Mr Adam in respect of Carillion. They make sobering reading and a reminder of why the Regulator exists.

You can read the FCA's news item below and within that, the links to both Final Notices.

No matter which sector you belong to, if you're a board member or a senior manager (of any SMF type), you'd be wise to give this your attention.

We're back after the break and 2026 is already off to a (very cold) flying start! We’re feeling refreshed, focused and ready for the year ahead.

We’re really fortunate to be working on some meaningful projects over the coming weeks, including Board Effectiveness, Vulnerability and Consumer Duty reviews, SMF Skills Development and Non-financial Misconduct training delivery.

It’s great to be able to support firms who understand the importance these areas and we’re looking forward to seeing how these initiatives develop through 2026.

I sometimes speak with people who are about to step into a senior manager role under the SMCR for the first time and what I've noticed is that the same theme keeps coming up and that's 'apprehension'.

From the moment you move from being part of the leadership team to being personally accountable for an area of the business, everything changes. It includes how you think, how you make decisions, how you collaborate with others and how others see you. It's a huge step to take and new senior managers feel it.

That’s why the new SMF Readiness Programme has been developed. It's suitable for individuals who are: being developed to step into a Senior Management Function role, preparing their application, waiting for regulatory approval or even as self-selected step in personal career development.

This programme is designed to help future senior managers to hit the ground running once regulatory approval has been granted, by building knowledge and skills as well as the right mindset for the challenges and expectations that come with regulatory approval.

It’s focused on what really matters when you step into the role.
