Most people spend a lot of time deciding who should inherit their estate.

Far fewer spend the same amount of time deciding who should administer it.

Yet choosing the right executor can be one of the most important decisions in your Will.

An executor may be responsible for dealing with Probate, paying debts, handling HMRC matters, managing assets and ensuring beneficiaries receive their inheritance correctly.

So who should you choose? A family member? A friend? A professional?

In our latest blog, we explore:

✔ What an executor actually does
✔ Whether you should appoint more than one executor
✔ Common mistakes people make
✔ When a professional executor may be appropriate
✔ The questions you should ask before making your decision

*"A lawyer with his briefcase can steal more than a hundred men with guns."*
– The Godfather. It’s a dramatic quote, but it highlights an important reality when it comes to inheritance disputes.

Many clients worry about adult children challenging their Will after they have gone. But does being a child automatically mean a claim will succeed?

In our latest Technical Tuesday article, Paul Tansley explores the Inheritance (Provision for Family & Dependents) Act 1975, recent case law, and the factors courts consider when deciding whether an adult child should receive financial provision from an estate.

The article examines:

✔ Who can make a claim
✔ When claims can be brought
✔ How courts assess financial need
✔ Recent successful and unsuccessful claims
✔ Why no estate is ever completely immune from challenge

An interesting read for practitioners advising clients who are considering excluding or limiting provision for adult children.

Further IPW Discussions with the Office of the Public Guardian

Representatives of the IPW Council met with the Office of the Public Guardian (OPG) last week to continue discussions around the operation of the Lasting Power of Attorney (LPA) service and the issues being experienced by practitioners and clients.

Several key concerns previously raised by the IPW were discussed again, including the ongoing issue of activation keys being issued to all parties involved in an LPA application. The IPW reiterated concerns about the practical implications of this approach and the potential impact on clients and advisers.

The Council also questioned why activation keys currently expire after 12 months, highlighting the difficulties this can create when LPAs are not required immediately following registration. The OPG acknowledged these concerns and advised that they will investigate further and provide a response. Discussions on these matters remain ongoing.

While no immediate changes were announced, the meeting provided a further opportunity for the IPW to represent members' concerns directly to the OPG and seek greater clarity on several operational issues affecting the profession.

The IPW will continue to engage with the OPG and will provide further updates to members as discussions progress - watch this space as this relationship continues to thrive.
