A Notice of Appointment of an Administrator was filed in the High Court of Justice, Business and Property Courts of England and Wales, Chancery, Insolvency and Companies List (ChD) on 2nd December 2024, following which Jon Mitchell of Westcotts Business Recovery LLP was appointed as Administrator to the following companies:

I have been appointed as proposed Administrator to a number of companies within the Marsh Group, which includes Harley-Davidson Plymouth, Harley-Davidson Southampton, Triumph Plymouth, Yamaha Exeter and Marsh used cars.

The team here at Westcotts Business Recovery have been busy.....
...with the expectation that the Capital Gains rates were to increase with the Budget, we saw an influx of Members' Voluntary Liquidations (MVL) in an effort to ensure that distributions were made pre-30 October and to crystallise the applicable (pre-Budget) tax rates of 10% BADR and 20% CGT.

Through the last couple of weeks, we have got through 19 MVLs and distributed over £128million of company assets to shareholders. 11 of these entered into MVL and distributions made in the last 2 days pre-Budget ensuring that the existing rates applied.

Post-Budget, we now know that the 10% BADR rate will remain for disposals up until 5th April 2025. However, as the main CGT rate increased to 24% as of 30th October 2024, a saving of 4% tax was welcomed by many shareholders where we distributed capital 'just in time'.

The early mornings and late evenings make it worth while....
..now, we plan again for further business owners who may want to sell or exit their business before April 2025 to make use of the existing 10% .

MVLs are still a very cost effective, tax efficient and popular process if you are considering how to exit your solvent business.

We are still seeing a high number of business owners making use of MVLs whilst the Business Asset Disposal Relief is still available, meaning an effective 10% rate paid on capital distributions made to shareholders in an MVL (up to £1m lifetime allowance).

Wilko has today entered Administration following the news a few days ago that a Notice of Intention had been filed.

It is no great surprise that more and more retail stores are seeking insolvency advice. Inflation, high interest rates, competition and the continuing cost of living crisis is continuing to take its toll on businesses from every sector.

We are taking calls daily from a wide range of businesses who are coming to us with much the same reasons for their current financial struggles. Early advice is always the best option.

The High Street homeware retailer has been unable to find a rescuer for its 400 stores.

These are required to be banked before 24 November 2022. If not, they will be sent to the Dorset Air Ambulance by way of a donation, as voted for by the Club and Members.
