If you’re purchasing a new-build property, you may be told that you must use the developer’s recommended mortgage adviser or solicitor in order to secure the property.

This practice is known as conditional selling and it’s important to understand your rights.

In the UK, you are free to choose your own mortgage adviser, lender and solicitor. A property developer or estate agent should not make the sale of a property conditional on you using their in-house services.

While developers and agents can recommend advisers or solicitors, the decision must always remain yours.
