EEBS CIS Payroll EEBS provides a HMRC compliant alternative to costly employment for UK construction companies We now pay 1000s of subcontractors every week.

EEBS Ltd originally established its current business model in 2001, in response to increasing pressure on contractors through changes to the Construction Industry Scheme. Throughout the last 20 years, the Revenue has accepted that every single one of our subcontractors is legitimately self-employed – WITHOUT EXCEPTION. CIS has evolved as a vehicle for Government to increase revenue taken from the

construction industry rather than to “protect tax revenue” as originally declared. The current CIS system is restrictive and punitive, exposing companies to extortionate fines and penalties for non-compliance of worryingly vague and over-complicated regulations. Many contractors have been forced into putting their subcontractors ‘on the books’ or having to let them go altogether. EEBS provides a Revenue-approved alternative to costly employment for contractors wishing to retain flexibility in their workforce. EEBS is a labour only subcontractor that engages subcontractors introduced by companies who wish to make use of their services. Here’s how it works:

- We engage the subcontractors (or any PAYE tradesman that wishes to convert to self-employment) under our own contracts.

- We agree to supply those subcontractors to you under our tailored Terms of Business
After each period of engagement (weekly, fortnightly monthly etc), you confirm the value of the works completed via our on-line Timesheets system or fax us a record.

- We pay the subcontractors

- We assume all responsibility for dealing with HMRC and/ or any Employment Tribunal with regard to those subcontractors. We are usually able to get you up and running within 24 hours of receipt of your agreement. For further information, please call us on 01245 493832

What does HMRC actually look for when they inspect a construction business? 🔎

During an employment status review, HMRC typically asks five key questions about your subcontractors:

1️⃣ Do they supply their own materials, plant and equipment?
2️⃣ Is a valid contract in place, or do they employ other subcontractors?
3️⃣ Can they demonstrate they can make a loss as well as a profit?
4️⃣ Do they have an active portfolio of other clients?
5️⃣ Do they have control over how the work is performed?

If the answer to most of these is NO — HMRC is extremely likely to reclassify the engagement as employment.

CIS or PAYE - it's one of the most common questions construction businesses face. 🏗️

Here's a quick breakdown:

📋 CIS: For self-employed subcontractors. Tax deducted at source: 20% if registered with HMRC, 30% if not. You submit a monthly CIS300 report to HMRC detailing all payments.

💼 PAYE (direct employment): Full employer National Insurance contributions, holiday pay, pension auto-enrolment, employment rights obligations. Switching from subcontract to direct employment typically increases payroll costs by significantly more than 40%.

Many construction businesses use a mix of both,and getting that balance right is where it gets complicated.

Missed your CIS monthly return? Here's what it costs you. 💸

The CIS300 must be submitted to HMRC by the 19th of each month, even if you haven't paid any subcontractors (a nil return is still required). Miss the deadline and penalties stack up fast:

📌 Late by any amount: £100
📌 Still outstanding after 2 months: additional £200
📌 Outstanding after 6 months: additional £300 OR 5% of CIS deductions - whichever is higher

And that's before HMRC's higher penalties for deliberate non-compliance.
