⚠️ THE MISTAKE THAT PUTS A FOREIGN NATIONAL’S RESIDENCE RENEWAL IN SPAIN AT SERIOUS RISK.
There is a VERY common mistake that is extremely difficult to fix.
A non-EU national applies for a type of residence permit that requires health insurance that meets Spanish immigration requirements.
They correctly take out a policy offering:
✅ Full medical coverage.
✅ No copayments.
✅ No waiting periods.
✅ Coverage equivalent to that provided by Spain’s National Health System.
They submit the documents.
Their visa is approved and they obtain residence in Spain.
And then they think:
“That’s it. I only needed the insurance to obtain the visa.”
WRONG.
When the time comes to renew their residence permit, taking out a new policy a few days beforehand may not be enough.
For non-lucrative temporary residence permits, current regulations expressly require applicants:
TO HAVE MAINTAINED HEALTH INSURANCE THROUGHOUT THE ENTIRE VALIDITY OF THE RESIDENCE PERMIT THEY WISH TO RENEW.
And to continue holding it.
It is not enough to be insured on the first day.
It is not enough to become insured again immediately before the renewal.
It is not enough to rush out and purchase a new policy when the immigration lawyer starts preparing the application.
The problem arises when the client:
❌ Fails to pay or returns a premium payment.
❌ Cancels the policy because they believe it is no longer needed.
❌ Changes to a cheaper policy with copayments or insufficient coverage.
❌ Leaves a gap of several days between two insurers.
❌ Remains uninsured for several months and purchases a new policy before renewing.
Then comes the question:
HOW CAN WE PROVE THAT THEY MAINTAINED HEALTH INSURANCE THROUGHOUT THE ENTIRE VALIDITY OF THEIR RESIDENCE PERMIT?
And this is the difficult part:
A NEW INSURANCE POLICY CANNOT TRAVEL BACK IN TIME.
An insurer can provide coverage from today onwards.
But it cannot certify coverage that did not exist three months, six months or a year ago.
Not even if the client is willing to pay more.
Periods without insurance cannot be filled retrospectively as if they had never existed.
Therefore, even a short interruption may prevent the applicant from proving continuous coverage and put the renewal at serious risk.
If you work with foreign residents in Spain, it is not enough to advise them to purchase insurance to obtain their visa.
They must understand one thing very clearly:
THE INSURANCE MUST BE MAINTAINED FOR AS LONG AS IT REMAINS A REQUIREMENT OF THEIR RESIDENCE PERMIT.
