نقابة المحامين… بين الحق والمسؤولية وصندوق الاقتراع

ليست نقابة المحامين مبنى ولا مجلسًا ولا أسماء تُعلَّق على لافتات.
نقابة المحامين ضمير.
وميزان.
ومسؤولية لا تقبل الهروب.

نحن لا نكتب اليوم عن انتخابات عادية،
ولا عن سباق مناصب،
بل عن اختبار وعي لكل محامٍ في مصر.

أولًا: التحية لمن تقدَّم… بلا شروط

كل التقدير والاحترام لمن قرر أن يتقدّم.
من وضع اسمه أمام الناس.
من قبل المحاسبة قبل المكسب.
من قال: أنا موجود، وأنا مستعد.

التقدُّم في ذاته موقف.
والهروب موقف مضاد.

ثانيًا: الاحترام لمن قدَّم سابقًا

هناك من خاض المعركة من قبل.
قد يصيب، وقد يخطئ.
لكن العطاء يُحترم،
والتاريخ لا يُمحى بالاختلاف.

نقد التجربة حق.
تشويهها خيانة للعدالة.

ثالثًا: لا عذر لمن لم يشارك

لا عذر لمن جلس متفرجًا.
ولا عذر لمن ترك غيره يختار عنه.
ولا عذر لمن اشتكى من النتائج وهو غائب عن السبب.

من لم يشارك…
أسهم بغيابه في الخلل،
وسيسأل عنه قبل أن يسأل غيره.

رابعًا: قبل أن نسأل “من فاز؟”

اسأل نفسك: ماذا قدمت؟

هل شاركت؟

هل راقبت؟

هل سألت؟

هل اخترت؟

الديمقراطية لا تعمل بالشكوى.
تعمل بالمشاركة.

خامسًا: المحاماة ليست وظيفة… بل شراكة عدالة

المحاماة في القانون المصري مهنة حرة.
شريك أصيل للسلطة القضائية.
محمية بحصانة قانونية.
ومسؤولة أمام المجتمع.

إذا ضعفت النقابة،
ضعف ميزان العدالة.

وإذا صمت المحامون،
تقدّم من لا يستحق.

سادسًا: الانتخابات ليست نهاية الطريق

الانتخابات بداية.
الرقابة بعدها واجب.
والمحاسبة حق.
والطعن القانوني طريق مشروع إن ثبت الخطأ.

لكن كل ذلك لا قيمة له
إن لم نكن حاضرين من الأساس.

الخلاصة

تحية لمن تقدّم.

احترام لمن قدّم.

لا عذر لمن غاب.

نقابة المحامين ليست هم…
نقابة المحامين نحن.

ومن يهرب من الاختيار،
لا يملك حق الاعتراض على النتيجة.

No Conviction Without Certainty:
A Legal Perspective on Cyber Extortion and Digital Evidence

In an era where digital communication dominates daily life, cyber extortion and electronic crimes have become among the most serious and sensitive criminal allegations.
Yet, the gravity of such accusations does not diminish a fundamental legal truth:
No individual is convicted by assumption.
No rights are taken by suspicion.
And no accusation stands without decisive and certain proof.
This principle lies at the heart of criminal justice and remains fully applicable—even in the digital age.
The presented video is a professional legal reenactment set inside an Egyptian criminal courtroom, addressing a cyber extortion case allegedly committed through the internet. The purpose of this work is not dramatization, but legal clarification: to illustrate how criminal responsibility is assessed when accusations rely on electronic messages, digital records, and technical reports.
Cybercrimes, by their nature, require a higher degree of technical certainty.
Forwarded screenshots, copied conversations, or unverified digital content do not, by themselves, establish criminal liability. What the law demands is:
A verified digital source
A clear and uninterrupted chain of custody
Technical attribution that conclusively links the act to the accused
Evidence free from doubt, manipulation, or alternative interpretation
Where such requirements are absent, the evidentiary value collapses, and with it, the accusation itself.
Legally, the crime of extortion requires a serious, direct, and proven threat, conclusively attributed to the accused.
If the identity of the actual user remains uncertain,
if the technical report fails to establish authorship,
or if the evidence allows for hacking, impersonation, or misuse,
then a core element of the crime is missing.
And where doubt exists, the law is unequivocal:
The presumption of innocence prevails.
Doubt must always be resolved in favor of the accused.
The burden of proof rests entirely on the prosecution.
This work aims to raise legal awareness, reinforce respect for due process, and emphasize that justice is not served by haste or public pressure, but by adherence to legal standards—especially in the rapidly evolving digital environment.
