Occupational disability insurance rejected due to pre-existing illness – what to do?

The occupational disability insurance company can reject an insurance application for the following reasons:
1. Pre-existing illnesses or health problems that could increase the risk of occupational disability
2. dangerous jobs or activities that involve a higher risk of occupational disability
3. incorrect or incomplete information in the application process.
Before you are rejected due to pre-existing illness or health problems, we recommend that you submit an anonymous preliminary risk inquiry to the insurer, ideally from your insurance broker. Especially if the applicant has had a medical condition in the past.

BU – Make an anonymous preliminary risk inquiry
An anonymous risk inquiry is a request you as a potential policyholder can make to obtain information about your insurability without revealing any personal information. This type of request does not provide personal information such as name and address.

The anonymous preliminary risk inquiry allows you to find out in advance whether the insurance company would be willing to insure you due to certain circumstances or pre-existing illnesses. This can be helpful if you are concerned that certain factors may affect your insurability.

It is important to note that an anonymous preliminary risk inquiry does not represent a binding commitment to insurance. The insurance company can still decide whether or not to accept your application after receiving further information or when actually submitting your application.

Rejection after anonymous preliminary risk request
If your occupational disability insurance (BU) was rejected due to an anonymous preliminary risk inquiry, there are various steps you can take to possibly still be accepted:

To address a denial based on your medical record, you could take the following steps:

Step1: Submit a request to your family doctor for delivery of the patient file.
Step 2: Once you have received the patient file, review all diagnoses with your insurance broker. If you had health problems a few years ago that justified a refusal to be included in the insurance and these problems or illnesses have now completely subsided, contact your doctor and ask him to make corrections. If you have had several family doctors and been treated by several doctors, it makes sense to apply for a patient file from the Association of Statutory Health Insurance Physicians. In this case, too, it is advisable to go through all medical reports and possibly ask for corrections. Example: A few years ago you were diagnosed with a herniated disc. You are now completely symptom-free and the herniated disc has healed. In this case, the treating orthopedist should be consulted and asked for a new diagnosis. This means that the occupational disability insurance can no longer refuse the health examination; nothing would stand in the way of inclusion in the occupational disability insurance.

Step 3: If the insurance company still refuses to accept you, you should lodge a written objection with the insurance company. Explain your arguments and, if necessary, attach additional medical documents or other relevant information.
Step 4: Seek legal advice. If the appeal is unsuccessful or if you believe your rights have been violated, you may contact a lawyer or your insurance broker to review your legal options. An expert can help you understand your rights and take further steps if necessary.
Alternative solutions to occupational disability insurance:
1. Special tariffs for pre-existing illnesses
If an applicant has been rejected by occupational disability insurance due to health problems and an appeal has also been unsuccessfully lodged, there are still some options for taking out disability insurance. One option is to look for insurance companies that offer special rates for people with pre-existing conditions. While these plans may be more expensive or contain certain exclusions, they still allow people with health problems to purchase disability insurance.

2. Alternative – Accident insurance
Another option is to consider an alternative insurance solution such as disability insurance or accident insurance. Accident insurance covers permanent accident damage starting one year after the accident. The exact conditions and benefits of accident insurance can vary depending on the insurance company.
