๐Ÿ’กOn 29 September 2026, the ๐‚๐ฒ๐’๐„๐‚ - ๐‚๐ฒ๐ฉ๐ซ๐ฎ๐ฌ ๐’๐ž๐œ๐ฎ๐ซ๐ข๐ญ๐ข๐ž๐ฌ ๐š๐ง๐ ๐„๐ฑ๐œ๐ก๐š๐ง๐ ๐ž ๐‚๐จ๐ฆ๐ฆ๐ข๐ฌ๐ฌ๐ข๐จ๐ง issued Circular C801, drawing the attention of Cyprus Investment Firms (โ€œCIFsโ€) to ESMA Q&A 2785 concerning the treatment of interest earned on client funds deposited with credit institutions.

The ESMA Q&A clarifies that, under Article 16(9) of MiFID II, an investment firm may not retain interest accrued on client funds held with a credit institution, as this would constitute use of client funds for the firmโ€™s own account.

In response, CySEC has withdrawn Circular ฮ•ฮ“144-2009-07 with immediate effect and has stated that the position previously set out therein should no longer be relied upon by CIFs. Firms are expected to review, without delay, their existing arrangements relating to interest generated on client funds and to take the necessary measures to ensure compliance with the applicable safeguarding requirements.

CySEC further expects senior management to oversee the implementation of the required actions, while relevant control functions including; Compliance, Internal Audit and External Audit should take these developments into account in the course of their reviews and reporting. CySEC may also request firms to demonstrate compliance as part of its supervisory activities.
