CERB Announcement
Important news for many people struggling through the pandemic with reduced income and debt.
The Canadian government has just confirmed that Crown claims for CERB over-payments can be included in Consumer Proposal and Bankruptcy proceedings. This means that when an estate is filed by a Licensed Insolvency Trustee, the individual will be immediately protected from collection efforts for CERB debts, and the amount owed for over-payments & erroneous payments will be discharged, (unless it is established that the CERB was obtained by fraud or misrepresentation).
I believe that most trustees, including myself, have been making an educated assumption that the payments could be dealt with by using Consumer Proposal or Bankruptcy options, but it is comforting to receive this official confirmation.

When I reflect on the quality of life that I gain from having my own practice, my comfortable head office in the walkable James Street South neighbourhood always comes to mind. Whenever I read about personal wellness, a frequent topic is feeling moments of gratitude.
I was filled with gratefulness today as I rode my 30-minute commute through a tree lined trail down the escarpment on a sunny spring morning. How lucky am I to start my day by riding along the edge of the Hamilton mountain with a view of the harbour and the occasional turkey vulture catching an updraft beside me? Then the main part of my journey takes me along the popular radial trail, (thanks Terry Cooke). An easy downhill leg that lasts for about fifteen greetings exchanged with hikers as I pass by cliffs, trees, waterfalls, golf courses, and yes, one big parking lot. Part three of my commute rolls through the tree lined side streets and bike lanes of the lower city until I arrive at my back door.
I start my day appreciating the feeling of arriving at my office with time spent in nature, some purposeful exercise, and zero pollution. On a beautiful day like today I can look forward to a workout on my uphill trip home.

Consumer Proposal – Covid 19 Deadline extension.

The Chief Justice in the Ontario Superior Court of Justice has issued an order extending the time for making Consumer Proposal payments in Ontario, (under very specific circumstances).
Basically, Consumer Proposals active on April 27, 2020 will be granted an extra three months’ grace for payments that become overdue up until December 31, 2020. In general, this means that Consumer Proposals will only be deemed annulled if they are in arrears for an amount equalling six months’ payments.
This is welcome relief to everyone currently in a Consumer Proposal and experiencing additional income challenges due to the pandemic.
(This post is a very brief description of a court order and is not meant to provide legal advice. Please discuss the effect of this order directly with your Licensed Insolvency Trustee for advice regarding your specific situation. Unfortunately, the relief by the Court does not apply to proposals that were already deemed annulled before April 27th).
