Own, operate or plan to develop a vacation rental? The government has announced a registration and regulation plan. Here’s what it could mean for you:
📝Who needs to register?
* All existing vacation rentals, including those that already have the required permits.
* Registration will be open for three months. The dates and procedure will be announced separately.
🗓Why is November 1, 2026 important?
* It is a reference date - registration does not automatically open or close on this date.
* Properties operating before this date that are registered will be assessed as existing vacation rentals.
* Not yet operating? A transitional arrangement may apply if you register and can prove concrete commitments made before this date that are difficult to reverse, such as a financing agreement or construction contract. An idea alone is insufficient.
🧐Does registration guarantee approval?
* No. It does not automatically grant a permit, legalize the accommodation or authorize expansion.
* Each property will be assessed individually.
* Location, existing rights, guest capacity, safety, parking and the impact on the neighborhood and environment will be considered.
* Existing lawful rights will be respected.
🚧Planning a new vacation rental?
* New plans in the designated centers of Oranjestad and San Nicolas may also be registered for assessment.
* Approval is not guaranteed.
* New projects outside these centers are excluded from this particular arrangement.
✅ How can you prepare?
* Gather your existing permits and property documents.
* Keep evidence showing when rental operations began.
* For projects under development, retain dated financing and construction agreements.
* Watch for the official registration dates and required documents.
These are preparation tips; the government will announce the official document requirements separately.
⚠ Don’t overlook registration
Under the announced plan, unregistered accommodations will fall outside the temporary tolerance arrangement and will not qualify for legalization through this process.
The temporary policy still requires legal review and approval before taking effect. It does not provide permission to open new accommodations, add units or expand existing properties.
