📣 Fair Work on warpath over slack payslips, poor record-keeping

"Small business pay practices have become a target for Fair Work and big fines await those with compliance shortfalls, says KeyPay co-founder and head of product Phil Bernie.

Speaking on this week’s Accountants Daily podcast, Mr Bernie said millions in underpayment by big companies captured headlines but Fair Work was putting small business pay records under the microscope too.

“There’s a trend particularly in agriculture where Fair Work are coming in and doing audits and reviewing farmers,” Mr Bernie said. “Pay accuracy is one thing they’re big on, but we saw the other day $20,000 fines being issued for record keeping.

“You don’t have to be employing 2,000 or 3,000 people to be on the radar for Fair Work. They are going out and targeting specific industries and you could just be employing 20 or 30 people and all it takes is for one person to query a pay slip or to raise a query with Fair Work and you could be on the radar.”

📣 New changes to home-based business expenses - An update from the ATO

"If you operate some or all of your business from home, you may be able to claim the business-use portion of expenses you incur.

For example:

- Occupancy expenses (such as mortgage interest or rent, council rates, land taxes, and home insurance premiums)
- Running expenses (such as electricity, gas, phone, internet, stationery, cleaning, and the decline in value of assets).
- The temporary shortcut method ended on 30 June 2022, and the fixed-rate method has been revised.

For the 2022–23 income year, the revised fixed rate is 67 cents per hour. You no longer need to:

- Have a dedicated home office space.
- Work out the business-use portion of phone, internet, gas, and electricity separately."

Four-day weeks ‘a bad fit’ for many small businesses ⚠️

"Four-day weeks will be a bad fit for many small businesses and make some unviable as they struggle with rising wages and staff shortages, COSBOA says.

Chair of the small business body Matthew Addison said many questions needed to be answered before the idea, currently being trialled in larger businesses, became mainstream.

“How does a small business stay open if their retail shop has no available stuff? How does that retailer earn sales on day five when it is shut?” asked Mr Addison.

“How does the customer service centre provide coverage over all hours of operation when the staff only work four days per week?”

“How does a service business (hairdressing, consulting) continue to provide 38 hours of services if the employee is only working 30.5 hours?”

COSBOA acknowledged trials of four-day work weeks had met varying levels of success, but said the majority had taken place in organisations with 45 or more employees, neglecting the effect it could have on small businesses."

"Xero has been granted a deferral on the start date of the STP Phase 2 for our payroll software, and this applies to all new and existing customers.

This means that all customers reporting STP using Xero Payroll have until 31 March 2023 to report their first STP Phase 2 pay run, instead of the 1 January 2022 ATO deadline.

This gives our Xero Payroll customers more time to ensure that payroll records are STP Phase 2 compliant."
