Use this before you add any new investment to your SMSF. Use it annually. Use it right now if anything this week made you pause.
These are the questions in the DIVA Academy SMSF Trustee Safety Self-Assessment.
Have you read your fund's trust deed in the last 12 months?
Can you describe the fund's investment strategy in your own words?
Does your fund's auditor have any professional, business, or referral relationship with your financial adviser or accountant?
Are no more than 5% of the fund's assets in related-party investments?
Are there any loans from the fund to you, a relative, or any related party?
Is the facility you acquired compliant with LRBA legislation, and is the documentation you have personally read acceptable?
Are all dealings with related parties at independently verifiable arm's length terms?
Has your fund received a qualified audit opinion in the last three years?
Could you provide ASIC or the ATO with full documentation of any transaction within seven days if asked?
Any 'No' on items relating to SIS Act s65, s67, s84, or s109 indicates a probable contravention. Independent advice this week may be the best thing you do!
Any 'Unsure' on auditor independence or related-party transactions triggers an independent file review.
Two or more 'No' or 'Unsure' answers indicate a structural problem.
