𝗧𝗵𝗲 𝗮𝗻𝗻𝗼𝘂𝗻𝗰𝗲𝗺𝗲𝗻𝘁 𝗹𝗮𝘀𝘁 𝘄𝗲𝗲𝗸 𝗮𝗯𝗼𝘂𝘁 𝗽𝗿𝗼𝗽𝗼𝘀𝗲𝗱 𝗰𝗵𝗮𝗻𝗴𝗲𝘀 𝘁𝗼 𝘁𝗵𝗲 𝘁𝗮𝘅𝗮𝘁𝗶𝗼𝗻 𝗼𝗳 𝗳𝗮𝗺𝗶𝗹𝘆 𝘁𝗿𝘂𝘀𝘁𝘀 𝗵𝗮𝘀 𝘂𝗻𝗱𝗲𝗿𝘀𝘁𝗮𝗻𝗱𝗮𝗯𝗹𝘆 𝗿𝗮𝗶𝘀𝗲𝗱 𝗮 𝗳𝗲𝘄 𝗾𝘂𝗲𝘀𝘁𝗶𝗼𝗻𝘀. 🔎

Rather than adding to the noise, we wanted to share our perspective on what the latest exposure draft could actually mean for families who use discretionary trusts.

Our adviser Thomas Sweeny has put together a new article looking at the proposed 30% minimum tax, the changes Treasury has now outlined, and some of the potential pathways available to existing family trusts.

One of the key points we took from the latest draft is that this isn't necessarily a case of “family trusts are no longer viable.”

There may be options for some existing trusts to elect into a fixed-distribution regime, including the potential to nominate eligible companies as beneficiaries.

But there is an important consideration: 𝘁𝗮𝘅 𝗼𝘂𝘁𝗰𝗼𝗺𝗲𝘀 𝗮𝗿𝗲 𝗼𝗻𝗹𝘆 𝗼𝗻𝗲 𝗽𝗮𝗿𝘁 𝗼𝗳 𝘁𝗵𝗲 𝗱𝗲𝗰𝗶𝘀𝗶𝗼𝗻.

A family trust may also play an important role in asset protection, business ownership, succession, estate planning and managing wealth across generations. Giving up some flexibility to achieve a particular tax outcome needs to be considered in that broader context.

For now, our view is simple: 𝗱𝗼𝗻'𝘁 𝗽𝗮𝗻𝗶𝗰, 𝗯𝘂𝘁 𝗱𝗼𝗻'𝘁 𝗶𝗴𝗻𝗼𝗿𝗲 𝗶𝘁 𝗲𝗶𝘁𝗵𝗲𝗿.

The proposed changes aren't law yet, and there is still consultation and further legislation to come.

The most valuable thing families can do now is understand their current structure, consider how the proposed changes could affect them, and be ready to make an informed decision when there is greater certainty.

Aged care decisions are hard enough without families feeling pressured, rushed or unsure about what they are agreeing to.

Recent media coverage has again highlighted the risks vulnerable older Australians and their families can face when aged care fees, contracts and “optional extras” are not clearly understood.
