As new regulations come into effect with the commencement of the 2025-26 financial year, QMS or quality management systems are now a requirement across the industry for bookkeepers and BAS agents. Service providers are mandated to implement documented systems and processes which demonstrate compliance, consistency, continuous improvement, and risk mitigation.

Unregistered business 'trading names' will cease to be acknowledged by the ABN Lookup tool from November 1, 2025 onwards. Since 2012, when the Business Name Register was launched, ABN Lookup has listed informal trading names. From November this year onwards, this protracted transitional period will end, and only registered business names will be displayed on ABN Lookup. As formal ABN registration is obviously crucial for a business - and small businesses are no exception - we urge sluggish operators to take heed and get sorted out ASAP!

The ATO once again turns its gaze towards contractors. Businesses lodge payments made towards contractors as part of their taxable payments annual report (TPAR), and data matching will reveal inconsistencies between payments contractors are receiving and the taxable income they report each year. Where the ATO suspects improper reporting on a contractor's tax return, it will contact them or their designated taxation professional to request a corrected tax return, it warned earlier this year. Nobody wants unexpected correspondence from the ATO!

As of April 1 this year, small businesses that have a track record of failure to comply with tax regulations - including late or non payment, late or non lodgement, and incorrect reporting - may be moved to monthly rather than quarterly GST reporting by the Australian Taxation Office.

The ATO emphasises this change is intended to help small businesses with the establishment of "good business habits", for example by facilitating smaller, more manageable monthly payments rather than larger quarterly ones, for smoother cash flow. Businesses that disagree with their assessment may lodge an objection; businesses may also adopt monthly rather than quarterly payments voluntarily, if they so desire, which many have already done.

The clock is ticking: From July 1, 2025 onwards, newly passed legislation means that payments of the general interest charge (GIC) and shortfall interest charge (SIC) will no longer be considered tax deductible. While many in the tax world agree that GIC and SIC should never have been deductible in this way, businesses have become accustomed to their deductibility, with it being relatively common for a business to resort to a payment plan and deduct the interest paid to the ATO.

This change coming into effect at a difficult time of high interest rates, when a record number of businesses are already going into liquidation, is likely to result in a painful adjustment period. H&R Block director of tax communications Mark Chapman warns that businesses are better off reprioritising tax debts over repayments to other creditors.
