When was the last time you objectively looked around your property and considered the risk of harm to guests, workers or anyone else coming on site?
Who is responsible when a guest trips over?
A recent court decision found that an occupier (in this case a hotel) is entitled to assume that an entrant will take reasonable care for their own safety. However the court also stated that an occupier must consider that entrants might become distracted, inattentive or be less than careful when identifying foreseeable risks of harm.
A court will take these competing considerations into account in determining whether or not a duty of care has been breached. Just because a risk of harm is considered obvious, it doesn’t obviate the liability owed. In this case, the hotel was found to have breached its duty by failing to take precautions.

Read on to see if you may be affected. Once the mandatory data breach notification scheme starts, your business will need to report any ‘eligible’ data breaches to the Australian Privacy and Information Commissioner, Timothy Pilgrim, and notify customers who may have been affected as soon as possible.

When did you last check your anti-virus software?
Whilst only a small number of Australian organisations appear to be affected by the Wannacry ransomware virus now is the time to review your existing anti-virus software.
Is you operating software (Microsoft Windows) fully up to date, with all recent patches loaded and installed? The virus was identified earlier this year, and Microsoft has issued a patch to fix the problem in their software. It is critical that the patch is installed and operating properly.
Is your anti-virus and anti-malware software operating properly and fully up to date?
Do you have sufficient cyber insurance to respond if something does get through and affect your computers? You will need help to unravel the impact of the virus, and you may also need help if your business is closed while this happens.
Do your employees know how to identify spam emails? The best antivirus is no help if a staff member opens a suspect email attachment.

The Bureau of Meteorology expects higher than average cyclones to affect Australia between November and April.
Read on for some handy tips to safeguard your business…
- remove dead or rotting trees that overhang your property
- secure all loose items outside a property
- clear gutters and check that The roof of the property is secure
- check the conditions of roofs & repair any damage or loose tiles
- secure any boats or vehicles and move cars under cover
- prepare a room by room inventory of home contents
- prepare a storm readiness kit
- know where and how to turn off mains power, water and gas
