Trusts: Understanding Appointors and Successor Appointors

Most of us use a ‘trust’, often without realising it. All superannuation assets are held in trusts, be it a self-managed superannuation fund, an industry fund or other public offer fund.

However, many trusts, including many SMSFs, do not have an Appointor or a Successor Appointor. In times of disagreement between beneficiaries and the trustee this might be a costly omission, particularly if the matter requires litigation to resolve it.

Are there sovereign risks to wealth for Victorians?

Probably not...

However Victoria, or at least its political elite, has chosen a growth orientation heavily dependent on historically elevated rates of population growth.

The irony is that Victoria needs to invest even more to provide amenity to this expected increased population.

Should Victoria fail to invest, higher public transport and health care costs will be the most significant risks to the cost and quality of living of families and individuals in the middle of the income wealth scale.

It is during years such as FY-23 that some of the lesser appreciated aspects of equity investment can come to the fore. One of those aspects that we appreciate is adaption and evolution.

Regulation of personal financial advice in Australia has been increasingly knotty, often incoherent and always bureaucratic. Rules designed with the good intention of protecting the investor have led to extraordinary complexity without benefitting the very same investor.

The government has now moved to simplify things. But the devil will be in the yet-to-be announced detail.
