This happens more than it should!

A client comes to us. New relationship. We start asking the questions that should have been asked years ago.

Do you have any contracts in place?

Yeah, we have contracts.

Can we review them against your insurance program?

Sure.

So we sit down. We read the contracts. We review the policies. And then we start finding things.

Breaches of insurance requirements they never knew existed.

Policy limits that don't meet contractual minimums β€” non-compliant from the moment they signed.

Waivers of their insurer's right of subrogation β€” agreed to in the contract, never disclosed to the insurer, never endorsed on the policy.

Obligations to add the principal as an additional insured β€” agreed to in writing, never actioned, never approved by the insurer.

Indemnity clauses that assume liability their policy specifically excludes.

Agreements to insure the principal β€” made without the insurer's knowledge or consent.
