The proposed reforms to NSW Workers' Compensation system, focusing on changes to mental injury benefits are in the final stages. The Workers Compensation Legislation Amendment Bill 2025 has passed the lower house and is set for a final vote in the upper house.

The government argues that the reforms are necessary to prevent a projected 36% increase in insurance premiums by 2028, which could burden businesses with an additional $1 billion annually. Key changes include a gradual increase in the whole person impairment threshold for accessing benefits and damages, from 25% in October to over 30% by July 1 next year.

However, the Law Society of NSW has expressed concerns, stating that the proposed changes may exclude many individuals with psychological injuries from accessing the scheme. They suggest starting the threshold at 20% to ensure that severely impacted individuals can still make a claim. The Law Society has called for a return to the design stage with meaningful consultation involving diverse stakeholders.

The outcome of the upper house vote will determine the future of these reforms.

2018-19 Premium Changes

iCare announced premium changes for 2018-19 effective 30 June 2018. Below are the key changes:

Catastrophic claims contribution

iCare has lifted the burden of catastrophic claims on premiums. An employer whose premium is impacted by claims, the premium will no longer be affected in the unfortunate event one of your people is fatally injured at work.

Instead, a one-off contribution will apply to all employers when they make such a claim. You’ll see this referred to as the ‘Catastrophic Claims Contribution’. This is intended to remove the volatility in premiums for employers where a workplace fatality occurs.

This contribution goes towards providing vital support for the dependants of a worker who has passed away as a result of a work-related incident.

iCare will calculate how much you need to pay based on your Average Performance Premium at the end of the policy period in which the incident occurred, minus any excess you’ve already paid in relation to your claim.

The minimum Contribution you will pay is $1,000 and the maximum is $250,000 (based on your Average Performance Premium).

The contribution is invoiced at the end of the policy period in which the incident occurred, separately to premium.

Any related premium-impacting claims costs will not be included in claims history in future policy periods.

Premium capping

Experience rated employers will now benefit from greater premium stability with the introduction of premium caps.

A cap will be applied to an experience premium if the new premium rate is more than 30% greater/lower than the old premium rate. The cap applies where the increase/decrease in premium percentage rate is a result of a change in the employer’s claims experience, or due to amendments in the premium methodology.

The cap does not apply if the increase is because of:
an increase in wages
change to a WIC classification
a change of business activity.
This cap will be applied automatically at renewal – there is no action required by employers.

WIC Codes

Workers Compensation Industry Classification (WIC) codes have been reviewed with half of the rates increasing and the other half reducing reflecting the latest performance of each industry.

Auto renewals

Experience rated employers will now benefit from having their policy automatically renewed.
