CGT is changing. Your super isn't. πŸ›οΈ

The 2026 Federal Budget, handed down on 12 May 2026, has clients asking one question: how do the capital gains tax changes affect superannuation?

Here is the short answer. They don't.

From 1 July 2027, capital gains tax outside super is being rebuilt. The 50% CGT discount is replaced. Gains will be taxed at the higher of a 30% minimum or your marginal rate, after an inflation-indexed discount.

Superannuation, including Self-Managed Super Funds, is exempt from those changes.

Inside super the picture stays favourable. Assets held for more than 12 months keep a one-third CGT discount. Sold during accumulation phase, the effective tax on the gain sits around 10%. Sold while supporting a retirement-phase pension, the capital gain is generally not taxed at all.

So if you are weighing up a new property or investment, it is worth understanding what an SMSF can and cannot do before you decide. An SMSF can also give you more control and more flexibility over how your money is invested.

Property investors, this one needs action.

The 2026 Federal Budget reshapes how property and investment are taxed. Most measures are still moving through Parliament, so treat them as direction, not final law.

For established residential property purchased after 7:30pm AEST on 12 May 2026:
- From 1 July 2027, rental losses can no longer offset your salary or other income.
- The 50% CGT discount is replaced with an inflation-indexed model and a 30% minimum tax.
- Properties held before Budget night are grandfathered.

Small business, mostly good news:
- $20,000 instant asset write-off set to become permanent from 1 July 2026.
- Two-year loss carry-back proposed for companies under $1 billion turnover.
- Startup loss refundability from 2028/29.

Workers and individuals:
- Up to $250 Working Australians Tax Offset from 2027/28.
- The personal income tax rate for the $18,201 to $45,000 tax bracket is proposed to reduce from 16% to 15% from 1 July 2026, with a further reduction to 14% proposed thereafter.
- Claim up to $1,000 in work-related expenses without receipts from 1 July 2026.

Transition rules are still being clarified. If you are buying, selling or restructuring, plan before the detail locks in, not after.

These invoices can look convincingly official. Some are charging fees well above the legitimate ASIC rate.

Before you pay anything:
