Some CSA officers use what’s called “automated outbound dialling” whereby they are supposed to contact clients but instead let it ring a couple of times, hang up and record it as a unsuccessful call attempt. We shall let your mind be creative when coming up with situations where this would be seen as sinister.

One of the worst decisions that can be made is the fact a decision-maker makes the presumption determination that when your income decreases, they are able to set your income due to your earning capacity. The decision-maker presumes that you have made the decision to affect the child support assessment and forces it upon the parent to rebut this position. This is similar to assuming one is guilty and then forcing them to prove that they are innocent. This is almost criminal in itself.

For cash settlement purposes only:

If there is a clause in the final orders for settlement stating to the effect that "within the meaning of Part VII of the Family Law Act 1975 the parties intend the provisions mentioned shall as far as practicable finally determine the financial relationship between the parties to the relationship and avoid further proceedings between them". A case cannot be registered with the Child Support Agency and the child support payments are incorporated into the proceeds of the cash settlement.

The most important advice for separating parents: Please get your family law solicitor to include a clause in the agreement and final orders that part of the cash Property Settlement is to be in lieu of child support.
