๐Ÿ” KKC UAE INSIGHT PULSE โ€“ FRIDAY TRIVIA #37

The FTA has issued TAXP010 - Free Zones and Designated Zones for Tax Purposes, addressing one of the most common misconceptions in the UAE tax landscape: the assumption that a Free Zone or Designated Zone carries the same meaning across Corporate Tax, VAT and Excise Tax.

What has the FTA clarified?

For Corporate Tax purposes:
A Corporate Tax Free Zone is a Free Zone recognized under the Corporate Tax Law.
A Corporate Tax Designated Zone must satisfy two conditions:
- It must be a VAT Designated Zone; and
- It must also be recognized as a Free Zone for Corporate Tax purposes.

The FTA specifically clarifies that: A VAT Designated Zone is not automatically a Corporate Tax Designated Zone. This has particular significance for QFZPs conducting distribution activities, since the 0% Corporate Tax benefit for distribution of goods is only available where those activities are carried out in or from a Corporate Tax Designated Zone, alongside satisfaction of all other conditions.

For VAT purposes:
- Only areas listed in the Cabinet-approved Designated Zone list and satisfying Article 51 conditions qualify as VAT Designated Zones.
- Merely being established in a Free Zone does not make an entity subject to VAT Designated Zone treatment.

For Excise Tax purposes:
- Designated Zones are subject to separate requirements including customs supervision, security controls and appointment of a Warehouse Keeper.
- Businesses should independently verify whether their location has been approved as an Excise Tax Designated Zone.

Practical Repercussions
The clarification has direct implications for:
- QFZP eligibility assessments
- Distribution activity qualifying income analysis
- VAT treatment of goods movements
- Excise Tax warehousing structures
- Free Zone substance and operational planning
A business may be compliant under one tax regime but fail the conditions under another if assumptions are made based solely on location names.

Official FTA Clarification - https://lnkd.in/en8UQW7m

๐Ÿ’ก Insight Pulse Takeaway
TAXP010 reinforces that tax classifications should never be assumed based on commercial or licensing terminology. The clarification promotes greater certainty by aligning tax treatment with specific legislative definitions and reminds businesses that eligibility under Corporate Tax, VAT and Excise Tax must be assessed independently.

If your business relies on:
- QFZP status
- Designated Zone distribution activities
- VAT Designated Zone treatment
- Excise Tax warehousing, now is the right time to validate whether your location satisfies the relevant conditions under each tax regime separately, rather than relying on the Free Zone designation alone.

๐Ÿ” KKC UAE INSIGHT PULSE โ€“ FRIDAY TRIVIA #36

The FTA has issued Federal Tax Authority Decision No. 17 of 2026 on the Cases and Conditions for the Recovery of Input Tax Incurred on Employee Expenses, effective from 1 October 2026. This Decision follows the broader direction seen in recent VAT amendments and directives, where the FTA has increasingly moved from principle-based provisions to more detailed compliance conditions and documentary requirements.

What has been clarified?

Employee Transportation
Input VAT can be recovered where transportation is:
- Between residence and workplace
- To client locations
- For work-related activities
Provided it is not for personal benefit and employees cannot opt for a cash allowance instead.

Employee Meals & Beverages
Recovery is permitted where employees are located in remote or isolated locations and there are no reasonable facilities for food preparation or access to nearby restaurants. The benefit must be linked to the work or residence period and cannot be exchanged for cash compensation.

Employee Accommodation
Input VAT recovery is allowed where accommodation is driven by operational requirements rather than employee benefits.
The FTA places particular emphasis on:
- Proximity requirements to work sites
- Reasonable accommodation standards
- Limited personal elements
- No cash alternative available to employees
Additional relief is available for temporary accommodation provided to newly hired employees for up to 30 days.

Mobile Phones, Data Packages & Internet
Recovery is permitted where these services are required to perform job duties, including remote working arrangements. Employers must maintain:
- A documented usage policy
- Monitoring mechanisms
- Records supporting compliance and authorised business use
- Incidental personal use is acceptable, provided it is not the primary purpose.

Parking Fees
Input VAT on employee parking can be recovered where parking is incurred for business purposes and supported by internal policies, approvals and documentary evidence.

Why does this matter?
Historically, businesses often relied on general VAT recovery principles when analysing employee-related expenses. The emphasis is no longer simply on what is provided to employees, but on why it is provided and whether the employer can demonstrate compliance with the prescribed conditions.

๐Ÿ’ก Insight Pulse Takeaway
This Decision significantly reduces uncertainty around one of the most litigated areas of UAE VAT. More importantly, it transforms employee expense recovery from a subjective assessment into a compliance-driven exercise supported by policies, controls and evidence. Businesses that formalise these processes early will be best positioned to protect their VAT recovery claims.

๐Ÿ” KKC UAE INSIGHT PULSE โ€“ FRIDAY TRIVIA #35

The FTA has issued Federal Tax Authority Decision No. 15 of 2026 replacing Federal Tax Authority Decision No. 7 of 2023 & introducing a structured framework governing how eligible persons obtain and retain Corporate Tax exemption.

While exemption provisions already existed under the Corporate Tax regime, this Decision focuses on a question many taxpayers were asking: When, how & by what deadline should exemption applications be submitted?

Key Developments
1. Registration remains mandatory
Eligible exempt persons must still register for Corporate Tax before seeking exemption. Exemption is not automatic.

2. 90 Business Day application deadline
Eligible persons must apply for exemption after the end of the Tax Period in which exemption conditions are met and no later than 90 Business Days from the end of that Tax Period.

3. Retrospective relief windows introduced
The FTA has provided transitional relief for certain entities that became eligible for exemption under earlier legislation:
- Qualifying Investment Funds & eligible juridical persons covered under Cabinet Decision No. 34 of 2025 may apply by 31 December 2026 for qualifying periods ending on or before 31 August 2026.

- Persons covered under Cabinet Decision No. 55 of 2025 may also benefit from retrospective exemption mechanisms subject to prescribed timelines.

4. Clear pathway for wholly owned exempt structures
The Decision allows wholly owned & controlled subsidiaries of qualifying exempt entities to submit exemption applications, with final approval linked to the exemption status of the controlling exempt person. It also creates a special window for certain government-owned structures to regularize historical exemption positions.

Why this matters?
This Decision provides exempt entities with administrative certainty. The availability of an exemption is only one part of the analysis. The timing of registration, application, approval & effective dates now has a clearly defined framework.

๐Ÿ’ก Insight Pulse Takeaway
This Decision reflects the UAE's continued move towards a more predictable & administratively mature Corporate Tax framework. By establishing clear application timelines, transitional relief measures & exemption procedures, the FTA has significantly reduced uncertainty for exempt persons & strengthened confidence in the practical operation of the exemption regime.

If your organisation operates as a:
- Qualifying Investment Fund
- Pension or social security fund
- Public benefit entity
- Government-related entity
- Wholly owned exempt subsidiary
Now is the time to review both your eligibility & your exemption application timeline.

๐Ÿ” KKC UAE Insight Pulse - Friday Trivia #34

The UAE Cabinet has issued Cabinet Decision No. 149 of 2026, introducing important amendments to the Executive Regulation of VAT, effective from 1 October 2026 (with certain input tax apportionment provisions effective from the first tax year commencing after 1 October 2027).

Key developments

1. Input VAT recovery becomes increasingly evidence-driven

A new provision empowers restrictions on recovering Input VAT where consideration for supplies exceeding prescribed limits is paid or intended to be paid in cash, subject to conditions to be issued by the Minister.

Implication: Businesses relying on significant cash-based transactions should revisit payment processes and supporting documentation.

2. Composite supplies are now formally codified

The regulation now explicitly confirms that where multiple components are economically inseparable, they must be treated as a single composite supply and follow the VAT treatment of the principal component.

Implication: Businesses offering bundled products or services should reassess pricing structures, invoicing practices and VAT classifications.

3. Input tax recovery methodology has been redesigned

The input tax apportionment mechanism has been substantially refined, including new formulas for calculating recoverable input tax and a dedicated methodology for Government Entities and Charities.

Implication: Partial exemption calculations may require process and system updates before the new rules become effective.

4. Healthcare supplies expanded

The zero-rating rules now extend beyond specified medical products to include goods supplied in the course of providing zero-rated healthcare services where they are necessary for the provision of such services.

5. Employee-related input tax recovery clarified

The revised provisions provide additional clarity around employee-related expenses, including circumstances where contractual obligations, documented policies, and labour law requirements may support input tax recovery.

Official Legislation - https://lnkd.in/duixeMim

๐Ÿ’ก Insight Pulse Takeaway
This amendment reflects the UAE's continued shift toward a more robust, documented and governance-driven VAT environment. Beyond the technical changes, the broader message is clear: VAT recovery is increasingly linked to commercial substance, transaction transparency and disciplined compliance processes rather than relying solely on invoice-based support.

Businesses should not treat these amendments as routine legislative updates. Now is the right time to review:
Vendor and payment processes
Input VAT recovery policies
Employee expense frameworks
Composite supply assessments
Partial exemption methodologies
