EFS October 2025 Implementation of AARTO Act

What Is the AARTO Act?
The AARTO Act (Administrative Adjudication of Road Traffic Offences) is a new system for handling traffic fines in South Africa. Instead of each municipality managing fines separately, everything will now be handled by one central body: the RTMC (Road Traffic Management Corporation).

Key Dates to Remember
1 December 2025: 69 municipalities start using the AARTO system.
1 April 2026: The rest of the country joins in.
1 September 2026: The demerit points system kicks in.

How Will You Receive Traffic Fines?
Fines will be sent to the vehicle owner or proxy (e.g., rental company) within 10 days of the offence.
You’ll have 32 days to either:
o Pay the fine (and get a 50% discount), or
o Nominate the actual driver who committed the offence.
If you don’t pay or nominate, the full fine applies.
Disputes must be handled with the RTMC—not in court.
If fines aren’t paid, you won’t be able to renew your driver’s licence or vehicle registration. Your assets could even be seized to cover the debt.

What Is the Demerit Points System?
Starting 1 September 2026, traffic offences will add points to your licence. The more serious the offence, the more points you get. Examples of Offences That Add Points
• Speeding
• Drunk driving
• Driving under the influence of drugs
• Ignoring traffic signs or signals
• Running red lights or stop signs

What Happens If You Accumulate Points?
12 points = Licence suspended for 3 months + mandatory rehab program.
3 suspensions = Licence cancelled. You’ll need to start over with a learner’s licence and driving test.

Renting a Car? Here’s What You Need to Know
Rental companies will check your licence status before giving you a car. If your licence is suspended—or close to suspension—they may refuse to rent to you. If you commit an offence while driving a rental:
o The fine goes to the rental company first.
o They’ll redirect it to you (the person who signed the rental agreement).
o You’ll then receive the fine and must pay or dispute it.
Only the main renter can be held responsible—not additional drivers. Keep a log of who drove the car if you plan to nominate someone else. Rental companies charge an admin fee to redirect fines.
From 1 August 2026, rental companies (including EFS) can’t pay fines on your behalf. You must wait for the redirected fine and handle it yourself.

IMPORTANT
Please note that car hire companies will no longer be able to send copies of the fine to the renter or EFS from 1 August 2026. As the fine will be issued in the proxy’s name, any payment made before the fine is redirected into the offender’s name will result in the demerit points being allocated to the proxy—not the actual offender.
