Twin Peaks system of regulation

The Twin Peaks system has changed the regulatory landscape as we know it. It has implications for consumers, financial institutions and accountable institutions. The system has resulted in new legislation being passed and heightened responsibilities of Regulators.

The Twin Peaks model is characterised by market conduct (FSCA) and prudential regulators (SARS).

Market conduct addresses the unequal position of financial institutions relative to their costumers. The most vulnerable are retail clients who often lack information necessary to protect themselves from fraud, market-abuse and ill-informed advice and who rely ob financial institutions and their representatives to look after their interests. The FSCA (Financial Services Conduct Authority, previously known as FSB) promotes confidence in SA financial systems and esure well functionality and high ethical and professional standards in financial services institutions.

Prudential regulation is applied to banks, securities firms and insurance companies to ensure that they are financially sound and capable of meeting their obligations to customers. In SA, SARS are held responsible for this function.
