When Must Your Spouse Be Added to a Home Loan Application?

One of the most common questions we receive is:

"Does my spouse have to be on my home loan application?"

The answer depends on how you are married, and understanding this upfront can save you time, prevent delays, and ensure your application is processed correctly.

Here's a simple breakdown:

✅ Married In Community of Property (COP)
If you are married in community of property, you and your spouse share a joint estate. This means both spouses must be included in the home loan application, as both parties have equal rights and responsibilities regarding assets and liabilities. Banks require both spouses' consent before granting finance.

✅ Customary Marriage (Without an Antenuptial Contract)
In most cases, a customary marriage without a registered Antenuptial Contract (ANC) is regarded as in community of property. This means your spouse will also need to be included in the home loan application, and both parties will be required to provide the necessary documentation.

✅ Married Out of Community of Property (With or Without Accrual)
If you are married out of community of property, your finances are generally kept separate. In these cases, your spouse does not usually need to be a co-applicant, unless you choose to purchase the property together or the bank requests additional information based on affordability or credit requirements.

✅ Important to Remember
Even when your spouse is not required to be part of the application, banks may still ask for:

✔️ Your marriage certificate.
✔️ Your registered Antenuptial Contract (ANC).
✔️ Other supporting documents to confirm your marital regime and comply with lending regulations.

These are standard compliance requirements and help ensure your application proceeds smoothly.

Think You're Still a First-Time Home Buyer? Think Again.

Many people believe that if they haven't bought a home in years, or if they never applied for a home loan themselves, they still qualify as a first-time home buyer.

Unfortunately, that's not always the case.

Banks assess your property ownership history, and once you've owned residential property, you may no longer qualify for products and benefits specifically designed for first-time home buyers.

Here's what you need to know:

✅ You are generally no longer considered a first-time home buyer if:

🏠 A residential property has previously been registered in your name.

Whether you purchased the property yourself or financed it through a home loan, ownership recorded at the Deeds Office usually means you have already entered the property market.

🤝 You have owned property jointly with someone else.
Even if you only owned a percentage of the property with a spouse, family member or business partner, joint ownership is still regarded as property ownership.

🏡 You inherited residential property.
Receiving a property through inheritance can also affect your first-time buyer status, depending on the circumstances and the bank's lending criteria.

🏘️ You previously received a government housing subsidy.
If you've benefited from a housing subsidy in the past, you may not qualify for first-time home buyer products again.

🔍 Banks verify your ownership history.
Before approving a home loan, banks conduct thorough checks through the Deeds Office, credit bureaus and other verification systems to determine whether you've owned residential property before.

What does this mean for you?

If you no longer qualify as a first-time home buyer, you may experience:

• Different lending criteria.
• Potentially higher deposit requirements.
• Stricter affordability assessments.
• Different interest rate offers.
• Ineligibility for certain first-time buyer incentives or products.

That doesn't mean buying another property is out of reach, it simply means your application needs to be structured correctly.

Why speak to a bond originator first?

Every bank has its own lending criteria, and every buyer's financial situation is unique.

At Ebonds, we take the stress out of the home loan process by:

✅ Assessing your individual circumstances.
✅ Determining whether you still qualify for any available benefits.
✅ Comparing your application with multiple leading banks through one simple application.
✅ Negotiating on your behalf to secure the most competitive interest rate possible.
✅ Guiding you from pre-qualification right through to final bond registration.

Our goal is to ensure you understand your options before making one of the biggest financial decisions of your life.

💚 Best of all, our service is completely FREE to home buyers.

Whether you're purchasing your very first home, upgrading, investing, or buying again after many years, we're here to help you make informed decisions with confidence.

WHAT HAPPENS IF YOU GET MARRIED DURING YOUR HOME LOAN PROCESS?

Many South Africans don’t realise that getting married while your home loan is already approved and busy with attorneys can actually affect your property transfer process.

Here’s what you need to know 👇

If your home loan has already been approved and the property is still in the transfer stage at the attorneys, your marital status at the time of registration can play a major role in how the property is finally registered.

✅ If you get married IN COMMUNITY OF PROPERTY:
• A joint estate is automatically created.
• Attorneys and the bank must immediately be informed.
• Your spouse may need to provide:
✔️ ID documents
✔️ F**A documents
✔️ Marriage certificate
• The bank may request updated affordability assessments.
• The property could end up registering in BOTH spouses’ names.
• Your spouse may also become jointly liable for the bond.

⚠️ If not communicated early, this can delay the transfer process.

✅ If you get married OUT OF COMMUNITY OF PROPERTY (with a valid ANC signed BEFORE marriage):
• Your estate remains separate.
• The property can usually continue registering in your name only.
• The approved bond often stays unchanged.
• Attorneys will normally request:
✔️ Marriage certificate
✔️ ANC documentation

📌 IMPORTANT:
The key legal moment is NOT when the loan is approved…
It is when the property is officially REGISTERED at the Deeds Office.

That means even if:
• You applied as single
• Signed the OTP as single
• Received approval as single

…getting married before registration still requires updates to the legal and banking process.

💡 Our advice?
Always inform:
✔️ The conveyancing attorneys
✔️ Bond attorneys
✔️ Your bond originator
✔️ The bank

…as soon as your marital status changes.

At Ebonds, we believe informed clients make smarter property decisions. Our team helps guide buyers through every step of the home loan journey — including the unexpected situations many people never think about.
