Dr Eric Louw may refer to his 36-year-old practice in Standerton, Mpumalanga as a ‘dinosaur practice’, but for the locals, his solid, quiet presence has been trusted by generations of the same families. Louw represents a rapidly disappearing model of medicine – the full-service GP who does obstetrics, surgery, gastroscopies, ultrasounds and procedures most specialists would hesitate to attempt, all in a small-town setting where the public healthcare system has long since stopped filling the gap. Louw believes it will go extinct when he and his generation are gone. In this week’s Medical Brief…

With demand for weight-loss drugs soaring, and cheaper unregulated alternatives entering the market, the South African Health Products Regulatory Authority is intensifying enforcement against unregistered medicines, with a raid on a Pretoria pharmacy this week allegedly producing and supplying medicines “under the pretext of compounding but outside the legal framework of the law”.

In the courts, former midwife Yolande Maritz Fouchee, who was convicted of culpable homicide and multiple assault charges, is to be sentenced today in the Gauteng High Court, with the state pushing for a prison term and the court hearing that she had shown no 'remorse'.

On the research front, good news for sufferers of sleep apnoea is that after a successful phase 3 clinic trial, a pill is awaiting fast-tracked approval from the US Food & Drug Administration, a move that could bring relief to the almost 1bn people worldwide who are affected by this disorder.

Senegal is facing a deepening political crisis after President Bassirou Diomaye Faye dismissed his Prime Minister Ousmane Sonko, fuelling internal tensions and fears of unrest amid a ballooning debt problem. Faye sacked Sonko and dissolved the national government after months of tensions between the two men. Sonko's dismissal followed a parliamentary session last Tuesday, during which the Prime Minister openly criticised Faye for his approach to the debt crisis. Faye was in the unusual situation of owing his position, in large part, to his Prime Minister's popularity.

In Kenya, the High Court has issued a landmark ruling declaring that the blanket criminalisation of consensual s*x between minors is unconstitutional, in a decision expected to significantly impact the enforcement of the Sexual Offences Act. In a constitutional petition judgment, Justice Bahati Mwamuye held that applying Sections 8, 9, 11 and 43 of the Sexual Offences Act to adolescents engaging in consensual, non-coercive and non-exploitative s*xual relations violates the Constitution. The judge ruled that children deserve protection and guidance rather than punishment in cases involving consensual adolescent relationships that do not involve coercion or exploitation.

And the US has sanctioned a senior Tanzanian police official over allegations linked to the ‘torture and s*xual assault’ of East African rights activists Boniface Mwangi and Agather Atuhaire last year. US Secretary of State Marco Rubio said the State Department had designated Faustine Mafwele based on ‘credible information that he was involved in gross violations of human rights’. The sanctions come amid growing scrutiny of Tanzania's human rights record, with US lawmakers calling for tougher action. The two activists had travelled to Tanzania to observe the trial of opposition leader Tundu Lissu last May when they were detained and later released, with Kenyan Mwangi saying he was held for several days alongside Uganda's Atuhaire. Mwangi alleged that he was stripped naked, hung upside down, beaten on his feet and s*xually assaulted in detention, while Atuhaire also said she was r***d during her detention in Tanzania. Tanzanian police at the time dismissed the torture allegations, describing the activists' accounts as ‘opinions’ and ‘hearsay’.

CHILDREN'S ACT, S 29 CREATES A JURISDICTION OF CONVENIENCE, NOT A JURISDICTIONAL BAR

In HMM v DM the Johannesburg High Court, per Wilson J, held that s 29 of the Children's Act 38 of 2005, which permits care and contact applications to be brought in the court having jurisdiction over the child's area of ordinary residence, does not exclude another court that would otherwise have jurisdiction, provided it is in the child's best interests for that court to decide the matter. The word "may" signals permissiveness, not exclusivity. Relying on FS v JJ 2011 (3) SA 126 (SCA) and declining to follow the rigid reading of s 29 adopted in NAN v CN [2017] ZAECPEHC 61 and subsequent decisions, the court found jurisdiction on the basis that the applicant father acquired his parental rights in Johannesburg. On the merits, the court declined to endorse the Family Advocate's recommendation that the child be relocated from the Eastern Cape to Johannesburg, finding it insufficiently reasoned, over-reliant on an outdated expert report, and failing to engage with the child's current settled and happy circumstances with his primary caregiver.

The application to make the Family Advocate's recommendation an order of court is dismissed. The child's primary residence remains with the respondent mother in the Eastern Cape. The parties are directed to submit an agreed contact order by 5 June 2026, failing which, written submissions are due by 13 June 2026

ONE BITE AT THE CHERRY: CONCOURT SLAMS THE DOOR ON REPEAT ASYLUM APPLICATIONS

The CC (7-2) upholds Home Affair's appeal. The Refugees Act 130 of 1998 does not create a right for failed asylum seekers to lodge subsequent applications. The Act is designed for first-time applications only; no framework exists for subsequent ones. The definition of ‘abusive application’ (s1) alludes to prior applications but does not create a right to re-apply. Section 24(5) points firmly toward finality once an application is exhausted. Critical distinction drawn: first-time sur place claims ≠ subsequent sur place claims. The SCA erred by conflating the two. Non-refoulement (s2) is a powerful principle but cannot be used to strain an interpretation that the Act cannot reasonably bear. Any remedy lies in legislative amendment, not judicial interpretation. The ‘revolving door’ concern & separation of powers loom large in Kollapen J's reasoning. Nicholls AJ & Rogers J dissent.
