Breaking news: The Supreme Court has ruled that the US president exceeded his authority in imposing sweeping tariffs under emergency powers.⁠

In a ruling delivered on Friday, the Supreme Court said: ‘Our task today is to decide only whether the power to ‘regulate . . . importation,’ as granted to the President in IEEPA, embraces the power to impose tariffs. It does not.’⁠

Costco Wholesale has won the loyalty and almost religious devotion of tens of millions of members thanks to one tenet in how it has run its business since its founding decades ago. Everything it does is aimed at keeping costs low so it can offer shoppers the deals on top merchandise that keep them coming back in droves week after week.

It was in that spirit that Costco last autumn became one of the first major companies (along with the likes of Revlon and motorcycle-maker Kawasaki) to sue the Trump administration over its “Liberation Day” tariffs regime. Its strategy was vindicated on Friday, when the U.S. Supreme Court slapped down those tariffs as unconstitutional.

Costco was seen at the time as taking a big risk by being the most prominent U.S. company to publicly oppose President Trump, on his signature issue at that, at a time many CEOs seemed (as they still do) to live in terror of landing in the president’s crosshairs. Still, this was not an ideological move, but rather a classic Costco business move.

Costco is emerging as a high‑profile test case for whether big business can buck President Donald Trump’s crackdown on corporate diversity—and still win with investors and shoppers alike.

While rivals like Target and Walmart have moved to scale back diversity, equity, and inclusion (DEI) programs in response to political and legal pressure from Washington, Costco has largely held its course—and its business is thriving.

Over the past year, Costco’s board and new chief executive Ron Vachris have repeatedly and publicly reaffirmed the warehouse chain’s DEI commitments, even as the Trump administration has turned such programs into a political target.

The US Equal Employment Opportunity Commission is probing Nike in response to unspecified allegations that the company discriminates against White employees, the agency said Wednesday.

The agency said it is investigating potential discrimination against White workers that may have occurred in part due to “NIKE’s Diversity, Equity, and Inclusion-related 2025 Targets and other DEI-related objectives.”

The subpoena enforcement action is another sign of a shift in views on discrimination under the Trump administration, which has sought to end diversity initiatives and instead examine whether such programs unfairly target White people.

The EEOC said it is requesting information from Nike going back to 2018.

The EEOC said the agency filed the enforcement action after Nike failed to voluntarily provide all the information required by the subpoena. CNN reached out to Nike for comment.
