Brian Kane, CPC, QPA, QKA will be presenting "A Close Look at Compensation and Non-Discrimination Testing in Qualified Plans". One of the most important aspects of retirement plan administration is ensuring that the proper compensation is being used as defined in the plan document. In this session, we will cover when a plan must use Section 415 compensation, the Safe Harbor and non-Safe Harbor definitions of compensation, and when the compensation ratio test is necessary. We will also cover the different non-discrimination testing requirements of 401(k) versus 403(b) plans, top-heavy testing, and case studies involving the required combined plan testing for cash balance and 401(k) profit sharing plans.

Most qualified retirement plans are required to file an annual return with the IRS. For plans subject to Title I of ERISA, this requirement is satisfied by filing Form 5500 or Form 5500-SF with the DOL. Other plans may file an abbreviated form known as Form 5500-EZ. "Wow, what a year 2020 turned out to be. COVID-19 devastated the country (and the world!) with sickness, loss of life, and a forceful gut punch to our economy. Most of us will be very happy to put 2020 in our rearview mirror, but it will not be soon forgotten.

Retirement plans experienced an unforgettable year in 2020 as well. Before COVID-19 struck, an impactful law known as the SECURE Act became effective. Then came the CARES Act in response to the virus, the Paycheck Protection Program, and a myriad of governmental regulations and other new procedures that affected retirement plans. At the same time, we all learned how to work remotely, keep an office running with a skeleton onsite crew, and communicate with each other, our clients, their advisors, plus friends and family, without being able to meet in person.

Every December, we publish a newsletter with reminders and articles about recent developments. This year’s newsletter is by far the lengthiest we’ve ever published, because so much has happened. The articles are meant as short descriptions of current retirement plan topics. Please check out the Table of Contents and read through the articles that may be of interest. Let us know if you’d like a more in-depth discussion on any of the subjects.

Here’s looking forward to changes in 2021 that will lead to a healthy, happy, and successful future for everyone!"

Our 2020 newsletter is now available. You can read the newsletter here . As always, our newsletter covers recent regulatory updates, limits for the upcoming plan year, and recommendations for ongoing compliance matters. This year’s newsletter is our biggest ever with topics including the SECURE Ac
