Portuguese President Marcelo Rebelo de Sousa just promulgated the Government diploma that allows the realization by videoconference of authentic acts, such as public deeds or divorces. This is a regime that will be “optional” and will be in force for two years on an experimental basis.
"Given that the diploma provides that the performance of authentic acts by videoconference is established on an optional basis and for an experimental period of two years, after which it must be reassessed, in technological, financial and, above all, in terms of reliability in safeguarding the will of the people - thus echoing the negative opinions of the majority of the social partners of Justice, the President of the Republic promulgated the diploma establishing the temporary legal regime applicable to the realization, through videoconference, of authentic acts, terms of authentication of private documents and recognitions”, reads the note published on the Presidency’s official website.
The public deeds diploma had been approved by the Council of Ministers on July 22, and the Government's initial intention was that the measure would enter into force on November 15, but the head of State only now promulgated it.
According to the publication, which is based on a version of the diploma that may have changed in the meantime, acts subject to land registration, such as purchases and sales of real estate, mortgages or condominiums, will be covered. The same happens with the processes of separation or divorce by mutual consent or the qualifications of heirs.
