Neighbor’s Tree Falls on Your House - Who’s Liable?

If a neighbor’s tree falls on your house, determining liability depends on the situation. Here’s a quick guide:

🌳 Negligence: If your neighbor knew the tree was unsafe (diseased, unstable, or dying) and failed to act, they could be liable for the damages and removal costs.

🌪️ Storm or Natural Disaster: If the tree fell due to a storm or natural disaster, your neighbor’s insurance is unlikely to cover it.

✂️ Tree Cutting: If your neighbor tried to cut the tree down themselves and caused damage, they are responsible for the costs.

What to do if it happens:

1. File a claim with your insurance company.
2. Communicate with your neighbor about the incident.
3. Maintain your yard to prevent future risks.
Your insurance may help recover costs, and you could be reimbursed for your deductible if they successfully collect from your neighbor’s insurance.
